MINUTES <br />CITY COUNCIL <br />DECEM. BER 15, 2004 <br />Mr. ]3lesener introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2005-12-302 - ADOPTING AN ORDINANCE <br />AMENDMENT CHAPTER 903.020 OI% THE LITTT F. CANADA CITY <br />CODE, KNOWN AS THE ZONING ORDINANCE, ]3Y PROVIDING <br />FOR RF,GiIL ATIONS RF,I ATING TO THE SIZE OFACCESSORY <br />BU77_DINGS <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4) Blesener, Montour, Allan, Fahey. <br />Nays (1). LaValle. Resolution declared adopted. <br />VACATION- Mayor Fahey opened the Public Ifearing to consider the vacation of a <br />TRAIL pedestrian trail easement consisting of the east 1S feet of Lot 1, Blocl< 1, <br />EASEMENT - Market Place 3"~ Addition, the Mendota Homes towuoffice project. <br />MENDOTA <br />HOMES The City Administrator the vacation is being requested to simplify the <br />replatting of the towuoffice project. Mendota Homes will be rededicating <br />Che trail easement via a new description tied to the plat that includes <br />restoration provisions for the sidewalk and planting area. Mendota Homes <br />will also be granting an additional 8-foot wide strip for street right-of--way <br />along Middle Street. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Fahey, seconded by Blesener, the public hearing was <br />closed. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. 2004-I2-302-APPROVING TIIE vACATIONOF <br />PEDESTRIANTRAI] F.ASEMEN'/'ASREQIJESTEI)I3YMENDOTA <br />HOMES' b`U73.TECT TO THE REDEDICATION OF THE NEW <br />EASEMENTS FOR TRAl1 AND MIDDLE STREET AS DESCRIBED <br />733' THE C1T3'ADMINLSTRATOR <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4) Fahey, Montour, Allan, Blesener. <br />Nays (1) LaValle.
