MINUTES <br />CITY COUNCIL <br />DECEMBER 15, 2004 <br />VACAT:I:ON Mayor Fahey opened the Public Hearing to consider the vacation of a <br />MIDDLE portion of the Middle Street right-ol=way between Little Canada Road <br />STREET and Market Place Drive. <br />RIGHT-OT-WAY <br />The City Administrator noted that initially there were plans to provide for <br />ou-street parking along Middle Street as part of t7ie redevelopment of the <br />Rice Street/Little Canada ,Road area. It bas been determined that the on- <br />street parking would have been ineffective due to existing driveway <br />configurations. Therefore, the developer will provide additional on-site <br />parking made possible by this vacation. It is recommended that a portion <br />ofN[iddle Street be vacated, leaving a 50-foot right-of--way width. The <br />portions of Middle Street that will be vacated will be retained as drainage <br />and utility easements. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Blesener, seconded by Allan, the public hearing was <br />closed. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2004-12-303 -VACATING THAT PORTION OF <br />M]DDIl STREET RIGFIT-OF-WAYAS DZ;SCR773ED 13Y THE CITY <br />ENGINEDR AND RETAINING DRAINAGE AND ZITII ITY <br />EASFMDNTS' OVER THIS RIGHT-OIL-WAP <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5) Blesener, Allan, Fahey, Montour, LaValle. <br />Nays (0). Resolution declared adopted. <br />Montour asked if Middle Street would be posted as no-parking. The City <br />Administrator indicated that if there is an on-street parking problem, the <br />City could then post the street, sul7ject to Council action. <br />VACATION- Mayor Fahey opened the Public Hearing to consider the vacation of <br />DRAINAGE drainage and utility easements over Outlot A, Villas at Little Canada. <br />& UTILITY <br />EASEMIsNT- The City Administrator reported that the drainage and utility easements <br />THE VILLAS will be replaced when Outlot A is replatted for the townhome <br />development. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />
