M. 1:NUTGS <br />CITY COUNCIL <br />MAY 28, 2003 <br />6-foot high fence. A variance is being requested for this fence due to <br />concerns that Drummer has with both noise and safety. Drummer pointed <br />out the busy d~affic along Rice Street, and indicated that given her house <br />has no back yard, the fenced front yard would provide a safe place for her <br />children to play. <br />Fahey noted that the City Planner has indicated that a 6-foot high fence <br />could extend 16 feet out from the front of the house without the need for a <br />variance. Drummer reported that given the layout of the house, this would <br />not provide an adequate fence enclosure area. <br />The City Planner reported that a 4-foot high i'euce that is 25% open could <br />be constructed to the dimensions that Drummer would like without the <br />need foi' a variance. Drummer felt that a 4-foot high fence would be <br />acceptable if that was her only option. <br />It was the consensus of the Council to deny the variance given the lack of <br />a hardship. The Cowicil encouraged Drummer to work with City staff <br />regarding the type offence that is permitted without a variance. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Upon motion by LaVaie, seconded by Blesener, the public hearing was <br />closed. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RE,SO%UT/ON NO. 24113-5-10G -DEN PING THE VARIANCE 1%012 6- <br />FOOT HIGFI FENCE IN A REQUIRED FRONT I'ARD REQUESTED <br />131' KAREN DRUMMER FOR 3024 RICE STREET GIVEN THAT <br />THERE LS NO HARDS'HIF PRESENT TtIAT WOUI D WARRANT A <br />['ARIANCE <br />'T'he foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Montour, Blesener, L,aValle, Fahey, Anderson. <br />Days (0). Resolution declared adopted. <br />PRELIMINARY Mayor Fahey opened the Public Hearing to consider an application for <br />& 'FINAL I'LA'P- Preliminary and Final Plat for the Market Place 3"~ Addition. It was noted <br />MA:RK;/T PLACl, that the City Planner, City Engineer, and Planning Commission <br />TH1RD ADDI'CION recommended approval. <br />
