MINUTI?S <br />CITY COUNCIL <br />MAY 28, 2003 <br />The City Administrator indicated that this was a staff recommendation, <br />and the concern was with the aesthetics of a dry pond. The Admiuistrator <br />recommended that if the decision is to allow a dry pond, that the <br />homeowners association documents be drafted acknowledging their <br />ownership of the pond as well as maintenance responsibilities. <br />Anderson pointed out that the townhome association would own the pond <br />and would be responsible for it, but the residents of the senior building <br />will have a view of the pond. Blesener suggested that the townhome <br />association would have the ability to convert the pond to a wet pond, and <br />if the residents of the senior building felt strongly about it, they could <br />contribute toward the cost of maintaining a wet pond. <br />I'ahey agreed that if the City wanted water maintained in the pond, this <br />was the time to require it. LaValle felt that it was up to the townhome <br />associations whether the pond was wet or dry. "I'he City Administrator <br />suggested that the City could require the developer to escrow funds for a <br />period of five years to allow for conversion of the pond to a wet pond. In <br />that way, if the matter becomes an issue within that time frame, the pond <br />could be converted to a wet pond.
