1VlINUTGS <br />CITY COUNCIL <br />JUNU 11, 2003 <br />MASSAG'I; Mr. Ted McCann informed the Council that given the fact that he did not <br />TLiERAI'Y complete one class that was part of the courseworl< for massage therapy <br />UDUCATIONAL certification, he did not have either the diploma or certificate of graduation <br />RUQUIRUMLNTS that is part of the City Code requirement for massage therapy licensing. <br />McCann reported that in discussing this with the school he attended, their <br />requirement is that he retake the course before they will issue him a <br />certificate. McCann pointed out that he would not be able to take this <br />class until winter semester. McCann requested that the Council grant him <br />a special variance from the educational requirements for a period of time <br />to allow him to get his certif Cate in conjunction with granting him a <br />massage therapy license. <br />Fahey indicated [hat there was no mechanism in the ordinance for waiving <br />educational requirements for massage therapy licensing. Fahey felt that <br />the educational requirements should be adhered to and pointed out that <br />granting Mr. McCann special privileges under this ordinance would open <br />the door fo additional requests. Fahey felt that Mr. McCann's issue was <br />with the school he attended and suggested that he work with the school to <br />obtain his diploma. or certificate. <br />McCann pointed out that Maplewood's ordinance provides options for <br />waiving the requirement of a diploma or certificate. He also noted that <br />Falcon Heights will waive the graduation requirement based on the <br />individual's experience. <br />Fahey felt that the City's ordinance was a reasonable one and indicated <br />that he was not inclined to modify it. Fahey felt that creating a special <br />exception would be a bad precedent for the City to set. <br />131esener suggested consideration of the issuance of a temporary license to <br />McCann to give him the opportunity to complete the one class he needs <br />for certification given that he meets other educational requirements under <br />the ordinance. I3lesener made a motion to temporarily waive the <br />diploma/certificate requirement under the ordinance for McCann for a <br />period of one year subject to submission of a diploma/certificate of <br />graduation at the end of that time. Anderson seconded the motion. <br />.Fahey again indicated that the ordinance provides no basis for waiving <br />educational requirements and felt that the City should not make an <br />exception for an individual applicant. <br />It was noted that the Planning Commission will be considering an <br />amendment to the B-3 Zoning District to allow massage therapy as a <br />principal use on a conditional use permit basis at their meeting tomorrow <br />10 <br />
