MINUTES <br />CITY COUNCIL <br />JULY 23, 2003 <br />COLISEUM indicated that they have no problem with the request. The Planning <br />BILLIARDS Commission has recommended approval of the request. <br />Anderson asked about policing of the facility. Mike Melloy, Coliseum <br />Billiards reported that he is a former police officer and indicated that he <br />and his staff police the facility and enforce the rules. <br />Fahey asked if the Council had the discretion to make the CUP subject to <br />modification or revocation should problems occur at the facility. Fahey <br />suggested that he would prefer having this ability in the event of problems <br />or concerns, rather than bringing the CUP back to the Council for an <br />annual review. The City Attorney indicated that it was appropriate for the <br />Council to make the CUP subject to revocation in the event of problems <br />on the premises. <br />Melloy stated that he had no problem with this condition provided that <br />revocation did not occur for minor infractions and that he had the ability to <br />appear before the Council to defend himself and the business. <br />The City Attorney pointed out that revocation of a CUP would require a <br />public hearing. <br />Anderson asked for a clarification of closing times, indicating that he had <br />concern with inconsistent hours of operation and whether this would cause <br />enforcement problems. <br />Melloy indicated that he is requesting the extension to a 4 a.m. closing <br />time, but indicated that his plan would be to utilize the extended hours on <br />a discretionary basis. Melloy indicated that he would likely lock the doors <br />at 2 a.m. or 2:30 a.m. and begin cleaning up the facility, If there are <br />patrons inside who would want to play until 4 a.m., he would allow them <br />to do so. If customers came to the locked door and wanted to play, Melloy <br />indicated that it would be at his discretion whether or not to allow them in <br />depending on the circumstances. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by LaValle, seconded by Blesener, the public hearing was <br />closed. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOL UTION N0. 2003-7-I58 -APPROVING TIIE AMENDMENT <br />TO CONDITIONAL USE PERMIT EXTENDING THE HOURS OF <br />2 <br />
