USE PERMIT AT ITS DISCRETION IN THE EVENT OF ENFORCEMENT PR0731,EMS AT THE FACILITY The foregoing resolution was duly seconded by Fahey. Ayes (4) LaValle, Fahey, Montour, Blesener. Nays (1) Anderson. Resolution declared adopted. PROPERTY Mayor Fahey opened the public hearing to consider the division of DIVISION - property at 525 LaBore Road into two single-family lots. It was noted 515 LABORE that the Planning Commission has recommended approval of the ROAD - property division as requested. NEAMY/ GALLOWAY There was no one present from the general public present wishing to comment on this matter. Upon motion by Blesener, seconded by LaValle, the public hearing was closed. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 2003-7--159 -APPROVING THE DIVISION OF 525/515 LA130RE ROAD INTO TWO SINGLE-FAMILY LOTS SU73JECT TO COMPL IANCE WITH THE RECOMMENDATIONb` OF THE CITY PLANNER AND .S`UI3JECT TO TIIE DEDICATION OF 6-FOOT DRAINAGE AND UTILITY EASEMENTS ON LOT LINES The foregoing resolution was duly seconded by LaValle. Ayes (5) Blesener, LaValle, Anderson, Montour, Fahey. Nays (0). Resolution declared adopted. REVISED Mayor Fahey opened the public hearing to consider the revised Final Plat FINAL for Schroeder's Rice Street Second Addition as requested by Aldi Foods. PLAT - It was noted that the Planning Commission has recommended approval SCHROEDER'S of the revised final plat as proposed. RICE STREET SECOND Jesse Anesi, Aldi Foods, reviewed the final plat which now contains an ADDITION - outlot which encompasses the road access for Bally's as well as on which ALDI FOODS the Bally's sign will be located. Anesi indicated that the outlot will be combined with the Bally's property.
