MINUTES <br />CITY COUNCIL <br />JULY 28, 2003 <br />The City Administrator noted that of all the potential parties that were <br />involved when the berm and ditch were constructed, it appears only the <br />Army Corps of Engineers had any enforcement authority. Why didn't <br />they take action? Mr. Pogreba was not sure. <br />The City Engineer reviewed the 1965 survey data that shows the low point <br />was on the Sculley property. This data was prior to any development in <br />that area that Mr. Sculley believes caused the problems he is experiencing <br />today. <br />Mr. Pogreba reviewed Little Canada minutes from 1980. The Mayor <br />noted that follow up was poor on the part of the City and the property <br />owners. <br />The Council discussed cleaning the ditch and it was indicated that neither <br />the Watershed nor the Army Corps will participate financially. <br />Aichinger then reviewed the three criteria for determining the existence of <br />wetlands. They are soils, vegetation, and hydrology. <br />Sculley asked if the existing road could be filled. Aichinger said it would <br />be possible if the road isn't in a wetland. He also noted that a permit <br />would be necessary. <br />Pogreba suggested that opening the berm on the north and west sides <br />would be a solution to let the Sculley water into the holding area. The <br />City Engineer said that opening the berm will let water flow from the pond <br />onto the Sculley property. Pogreba's second suggestion was to clean the <br />ditch, again noting that it has not been cleaned since it was installed. He <br />also said the ditch along Beam Avenue should be evaluated. Aichinger <br />indicated that the Watershed will evaluate this potential solution for both <br />ditches. <br />There being no further business, the workshop was adjourned at 7:03 p.m. <br />~~ <br />Mic el 1.
