MINUTES <br />CITY COUNCIL <br />AUGUST 27, 2003 <br />Upon motion by Montour, seconded by LaValle, the public hearing was <br />closed. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2003-8-191-APPROVING THE AMENDMENT <br />TO THE PLANNED UNIT DEVELOPMENT TO AI,LOWA SALES <br />TRAILER ON THE SITE OF THE VILLA'S TOWNHOME <br />DEVELOPMENT SU73JECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE PLANNING COMMISSION <br />RELATIVE TO REVIEWAND APPROVAL I3Y THE BUILDING <br />OFFICIAL FOR COMPLIANCE WITH ACCES.S773IL ITY <br />REQUIREMENTS <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) LaValle, Blesener, Montour, Fahey, Anderson. <br />Nays (0). Resolution declared adopted. <br />AMENDMENT Mayor Fahey opened the Public Hearing to consider an Amendment to <br />TO CUP - a Conditional Use Permit to expand a car rental business to include the <br />2608 RICE rental of recreational vehicles at 2608 Rice Street as requested by U-Save <br />STREET - Auto Rental. The Planning Commission recommended denial of the <br />U-SAVE AUTO Amendment to CUP requested. <br />RENTAL <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Blesener, seconded by LaValle, the public hearing was <br />closed. <br />Montour noted the enforcement problem that U-Save Auto Rental has <br />been since they first opened for business. Anderson indicated that the <br />Council had some hesitancy in granting the initial Conditional Use Permit <br />for U-Save Auto Rental, therefore, restricted the storage of rental <br />automobiles to four vehicles. U-Save since moved I S recreational <br />vehicles into the area in violation of the Zoning Code. LaValle noted they <br />were also operating a u-haul rental business that the Code Enforcement <br />Officer had to address. <br />The City Administrator agreed that there has been an enforcement <br />problem with this business. He noted that in response to complaints, the <br />Code Enforcement Officer has been addressing these enforcement issues <br />with the owner of U-Save. It is because of her efforts, that U-Save applied <br />for the Amendment to the CUP to determine the Council's position on this <br />17 <br />
