Resolution declared adopted. <br />FORFEITURE Fahey requested that the City Attorney and the Sheriffls Department <br />PROCEDURES report at the next Council meeting ar forfeiture provisions as discussed at <br />the Council's workshop meeting. <br />BUILDING Mr. Jim Cossack, 421 Eli Road, appeared before the Council relative to <br />VIOLATIONS - building code violations on his property. Cossack indicated that he <br />421 ELI ROAD - disagreed with the Building OfficiaPs interpretation of the Code and <br />JIM COSSACK questioned the City's position that his property is in violation. Cossack <br />indicated that in order to resolve the issue, he is considering construction <br />of a ZS-foot basement plus an above-ground addition that will connect his <br />house to his recreation building. Cossack indicated that it was his position <br />that this connection will resolve the issues that have been raised. <br />Fahey stated that it is the City's position that the underground connection <br />proposed by Mr. Cossack is not a basement, but a tunnel structure and that <br />the Code would not consider this an appropriate connection of the two <br />structures. Fahey pointed out that stafl"s position is that the connection of <br />two structures into one must occur with an above-grade connection. <br />Fahey felt if the Code was ambiguous or unclear on this point, then the <br />Code should be amended to clarify the issue. Fahey also pointed out the <br />fact that Mr. Cossack started construction of his recreation building <br />illegally and was repeatedly told to stop construction. <br />Cossack admitted that he started construction illegally. He also informed <br />the Council that he missed the Council meeting at which his variance <br />requests were being considered as his secretary did not inform him of the <br />date and time of the meeting. Cossack felt that the Building Official's <br />handling of this matter has gotten personal, and that the Building Official <br />is not helping him to resolve the matter and will not work with him. <br />Cossack indicated that he has $50,000 in costs into the recreation building <br />
