MINUTES <br />CITY COUNCIL <br />OCTOBER 15, 2003 <br />based on the same formula used in 1992 for the previous improvement <br />project. That formula spreads the cost based on 50% of the cost assessed <br />on front footage and 50% on lot area. <br />The Engineer then reviewed assessment payment methods. Property <br />owners can pay their assessment at the City Center within the next 30 days <br />with no interest accruing on the assessment balance. Partial payments are <br />also accepted with the City then certifying the unpaid assessment balance <br />to Ramsey County for collection with property taxes. After expiration of <br />the 30-day period, any unpaid assessments are certified to Ramsey County <br />for collection with property taxes. The assessment balance is spread over <br />a period of 10 years with interest accruing at the rate of 5.5%. The <br />Engineer indicated that once assessments are certified to the County, the <br />property owner always has the option of paying off the assessment earlier <br />than the 10-year period. Early payoffs are made to Ramsey County and <br />are subject to statutory requirements. <br />Ron Neu, 3171 Spruce Street, asked why the railroad ties were not <br />removed as part of the 1992 improvement project. The City Administrator <br />indicated that the City was not aware of the railroad ties at that time and <br />thought that the heaving in the road was due to settlement from the <br />adjacent recycling operation. The Administrator indicated that the City <br />learned of the railroad ties during out neighborhood meeting to discuss <br />this project. <br />The Engineer indicated that as part of the project, the roadbed was <br />excavated down four feet, the railroad ties removed, materials were <br />replaced and a fabric barrier added between the fly ash and the sand. The <br />Engineer felt that the soils in the area are still unstable, but when they <br />move, the movement will be more uniform now that the railroad ties have <br />been removed. <br />There was no one else from the general public present wishing to <br />comment on this matter. <br />The City has no written objections to this assessment. <br />Upon motion by Blesener, seconded by Montour, the public hearing was <br />closed. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2003-IO-234 -ADOPTING THE ASSESSMENT <br />FOR RYANDRIVE, IMPROVEMENT NO. 2001-22, AS <br />
