MINUTES <br />CITY COUNCIL <br />NOVEMBER 12, 2003 <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (3) Blesener, Montour, LaValle. <br />Nays (0). <br />Abstains (1) Anderson. Resolution declared adopted. <br />VACATION LaValle opened the public hearing to consider the vacation of a <br />OT PORTION portion of Nadeau Road lying between Burke Lane ar the west <br />OT NADEAU and Condit Street on the east. <br />RAOD <br />David Miller, 2883 Condit Street, reported that he and his wife have <br />petitioned for the vacation so that they can construct a garage on the south <br />side of their house. Miller indicated that there had been a garage in this <br />location previously, but due to its disrepair, it was removed. In applying <br />for a building permit to replace this garage, they were informed of the <br />unimproved Nadeau Road right-of--way immediately south of their <br />property. The existence of this unimproved right-of--way requires that the <br />new garage be set back 30 feet their south property line. <br />Miller further indicated that he has been informed of a proposed <br />thoroughfare plan for the property immediately behind his house. He <br />stated that he had previously been unaware of this plan. He noted the City <br />Administrator's recommendation that a condition. of the vacation be that <br />25 feet of road right-of--way come from the north portion of his lot. <br />Additionally, the City Administration is recommending the dedication of <br />17 feet of additional right-of--way for Condit Street from the east edge of <br />the Miller property. Miller stated that he was not agreeable to the <br />dedication of these rights-of--way. <br />John and Mark Cn'ant, 2901 Condit Street, stated that they supported the <br />vacation of the Nadeau Road right-of--way as requested, but did not <br />support the thoroughfare plan for the property behind their home. John <br />Grant felt that there were alternatives to the layout of this thoroughfare <br />plan that could be explored. <br />It was noted that there is a private driveway easement across the Grant <br />property that provides access to 2905 Condit Street. <br />Grant also indicated that there are only four houses abutting Condit Street; <br />therefore, he did not believe additional right-of--way for Condit Street was <br />necessary. <br />The City Administrator noted that there is adequate right-of--way width for <br />Condit north of its intersection with Yorkton Ridge, but not to the south. <br />The Administrator pointed out that it will be necessary to reconstruct <br />
