MINUTES <br />CITY COUNCIL <br />NOVEMBER 12, 2003 <br />Condit Street some time in the future, and the City now has an opportunity <br />to obtain adequate right-of=way fa' this portion of the street. <br />Miller indicated that dedicating 17 feet ofright-of--way for Condit Street <br />will have a significant impact on his property. Miller reported that there is <br />a lot of traffic on Condit Street going by his house, including commercial <br />traffiq and the added right-of--way will increase existing traffic problems. <br />Miller stated that he was opposed to giving up this 17 feet of property. <br />The City Administrator indicated that it is staff's recommendation that the <br />additional right-of way be required, and noted that Condit Street will at <br />some point need to be reconstructed to better serve the neighborhood. <br />There is only 33 feet of right-of=way for Condit Street south of Nadeau <br />Road, and the City's minimum standard for a residential street is 50 feet. <br />The Administrator questioned the statement about commercial traffic on <br />Condit, noting that the commercial properties do not have access onto <br />Condit. The Administrator pointed out that the vacation being requested <br />provides some benefit to Mr. Miller in placing his garage. At the same <br />time, the City is looking to obtain adequate right-of--way for Condit Street, <br />as well as access to property to the west of the Miller property. <br />Miller indicated that he is only trying to replace a garage that had <br />previously existed, and questioned the benefit he would receive from the <br />vacation of Nadeau Road. <br />Montour pointed out that without the vacation, a variance would be <br />needed to place the garage where Miller is proposing. It is questionable <br />that a hardship exists that would justify granting a variance. Montour <br />pointed out that the City is proposing atrade-off by requesting the <br />dedication of needed right-of--way in exchange for the vacation of a <br />portion of Nadeau Road. <br />Blesener stated that he can understand that the Miller's and Grant's would <br />oppose the development of a road between their homes. However, there is <br />also the issue of the future development potential of the Fasciana property. <br />Blesener suggested one option would be to run a cul-de-sac in that would <br />end at the western edge of the Miller and Grant properties. The other <br />option would be to retain the Nadeau Road right-of--way as a potential <br />access into the Fasciana property. <br />Blesener stated that he was not in favor of vacating the Nadeau Road <br />right-of--way if the Miller's and Grant's were opposed to providing access <br />into the Fasciana property. Blesener pointed out that to vacate Nadeau <br />Road without aright-of--way dedication from one of these property owners <br />would landlock the Fasciana property. <br />
