MINUTES <br />CITY COUNCIL <br />DECEMBER 17, 2003 <br />Fahey noted that the pretrial is scheduled for December 24°i. If it is rescheduled, <br />Fahey hoped it would be rescheduled to January. Anderson felt that additional <br />citations should be issued after December 24°i regardless of whether the pretrial <br />is postponed or not. <br />LaValle asked if the courts would look unfavorably on the City if it began <br />issuing citations prior to the conclusion of pretrial proceedings. LaValle was <br />concerned that prior to the conclusion of the pretrial, Mr. Cossack would not <br />have had his day in court. The City Attorney indicated that he would have had <br />his day in court as he has been charged and appeared in court, but has done <br />nothing to resolve the violations. Fahey suggested that Mr. Cossack has also <br />had his day in court as he has appeared before the City Council and has ignored <br />the directives of the Council as well as City staff. Fahey agreed that after <br />December 24°i, the City should begin issuing citations as well as commence <br />civil action for the removal of the structures. Fahey suggested that the proposed <br />letter not be sent. Blesener indicated that he was not opposed to the letter being <br />sent as it once again outlines Mr. Cossack's options. <br />The City Attorney again recommended that the letter not be sent until after the <br />December 24'x' pretrial or, if continued, until after the rescheduled pretrial <br />proceedings are concluded. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RF.b'OL UTION NO. 2003-12-291-INSTRUCTING THE CITYATTORNEY <br />TO COMMENCE I,ECiA7 ACTION FOR THE REMOVAL OF THE <br />COSSACK NON-COMPLIANT STRUCTURES IMMEDIATELY UPON <br />CONCI. COSSACK <br />ON A WEEKLY I3A.SIS AFTER CONCI, USION OF PRETRIAL <br />PROCEEDINGS AND FOR AS LONG AS T HE NON-CONFORMITIES <br />CONTINUE TO EXIST <br />The foregoing resolution was duly seconded by Anderson. <br />Ayes (5) Fahey, Anderson, Montour, LaValle, Blesener. <br />Nays (0). Resolution declared adopted. <br />PLANNING The Council reviewed the applications for appointment to the Planning <br />COMMISSION Commission. Council noted that all four applicants are good candidates and <br />APPOINTMENTS the decision is a difficult one.
