MINUTES <br />CITY COUNCIL <br />DECEMBER 17, 2003 <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOI UTION NO. 2003-12-290 - CALLING A SPECIAL MEETING IN <br />ORDER TO CONDUCT A PU737IC HEARING ON TILE UNWEAVE THE <br />WEAVE PRO.IECT FOR MONDAY, JANUARY 26, 20/I4 AT 7:00 P.M. AT <br />THE CITY CENTER <br />The foregoing resolution was duly seconded by Nlontow'. <br />Ayes (5) LaValle, Montour, Fahey, Anderson, Blesener. <br />Nays (0). Resolution declared adopted. <br />COSSACK The City Administrator presented a letter he proposed be sent to Mr. Jim <br />ENFORCEMENT Cossack outlining the outstanding enforcement issues on his property at <br />ACTION 421 Eli Road and requesting he submit a plan for correction of these violations. <br />Fahey suggested that the City proceed with an enforceable action against Mr. <br />Cossack and resolve the matter as soon as possible. <br />The City Attorney reported that a pretrial was scheduled for October 29, 2003 <br />relative to the two charges against Mr. Cossack, but that pretrial was continued <br />to December 24°'. The City Attorney recommended that at this point, the City <br />wait until the pretrial is held before sending Mr. Cossack an additional letter. <br />The City Attorney anticipated that it will take a court order to compel Mr. <br />Cossack to comply with the City's ordinances. The City Attorney suggested <br />that after the pretrial and the jury trial the City would have the option of issuing <br />citations to Mr. Cossack on a daily basis. The City also has the option of <br />proceeding with a civil injunction, but that could take up to a year to get <br />scheduled on the calendar. <br />Fahey asked if in a criminal case the court would order removal of the structure <br />The City Attorney suggested that the court would not order removal based on <br />one set of complaints, but perhaps would if there were ten sets of complaints. <br />Fahey asked if the City should begin issuing additional citations and/or file an <br />injunction immediately after the December 24`x' pretrial. Fahey felt that the City <br />has waited long enough and should move forward to resolve this matter. Fahey <br />stated that a voluntary resolution to a problem like this is always better. <br />However, he was not confident that Mr. Cossack would comply with the City <br />ordinances on a voluntary basis. <br />Anderson agreed that a resolution outside of legal action was preferential, and <br />noted That the City Administrator's draft letter outlines Mr. Cossack's three <br />options that have been communicated to him in previous correspondence. <br />12 <br />
