MINUTES <br />CITY COUNCIL <br />DECEMBER 17, 2003 <br />AMENDING Mayor Fahey opened the public hearing to consider an amendment to the <br />ZONING Zoning Code relating to the Variance and Appeals process. It was noted <br />CODE - that the Planning Commission has recommended approval of the amendment. <br />VARIANCE <br />& APPEALS The City :Planner indicated that the amendment separates the Variance and <br />PROCESS the Appeals process and clarifies the standards for each. <br />There was no one present from the general public present wishing to comment <br />on this matter. <br />Upon motion by LaValle, seconded by Blesener, the public hearing was closed. <br />Blesener noted that the amendment establishes a 12-day process for filing <br />appeals. The Planner indicated that this timeframe is recommended in order to <br />try to avoid the situation where an appeal is filed, but a building is already under <br />construction. Anderson asked if the 12-day time period provided enough time to <br />provide notice that an appeal would be considered at the Council meeting <br />following the initial action. The City Planner indicated that an appeal would <br />occur at the second meeting following the initial action, and there would be <br />adequate time for notice. <br />Mr. LaValle introduced the following ordinance and moved its adoption: <br />ORDINANCE NO. 558 -AMENDING SECTION 922 OF THE I ITTLE <br />CANADA CITY CODE ADDRESSING VARIANCE AND APPEAL. <br />PROCEDURES AND REQUIREMENTS <br />The foregoing ordinance was duly seconded by Montour. <br />Ayes (5) LaValle, Montour, Blesener, Anderson, Fahey. <br />Nays (0). Ordinance declared adopted. <br />2004 BUDGET Mayor Fahey opened the public hearing to consider adoption of the 2004 Budget <br />and certification of the tax levy. <br />The City Administrator reviewed key elements of the 2004 Budget and tax levy, <br />noting that the Cowrcil has reduced the levy by $30,000 from what was <br />originally proposed. Part of this reduction is attributed to the Fire Department's <br />revised budget, acid the Administrator commended the Fire Department for their <br />efforts in lowering their budget request. Another factor in the $30,000 budget <br />reduction is due to an increase in building permit and plan check fees and <br />increased collections associated with the contract with Falcon Heights for <br />building and fire inspections. <br />4 <br />
