Allan questioned whether this price range was <br />realistic given most of the lots would have no back yards. <br />Allan asked what the hardship was of moving the road right-of--way off the <br />Williams easement. McDonnell replied that lots would be lost to do so. <br />Allan stated that if there is a disaster with the Williams pipe that <br />necessitates the road be disturbed, every taxpayer in the City will pay to <br />have this road reconstructed. Allan asked the developer to consider the <br />taxpayers of Little Canada and move the road out of the easement. Allan <br />also contended that the entrance monument for the development is <br />proposed to sit over the Williams pipe. McDonnell disagreed. <br />Dan Arcand appeared before the Commission and indicated that he lives <br />directly west of the proposed Preserve Trail. Arcand indicated that the <br />developer has never talked to him about the plat or the impact that <br />Preserve Trail would have on his property. Arcand stated that he saw no <br />reason that the road was pushed to the far west of the lot directly abutting <br />his property. Arcand pointed out that the result of this development is that <br />he will have roads on three sides of his lot. Arcand asked that something <br />be done to resolve the road issues to the benefit of the existing property <br />owners in the area. <br />David Crary, Sunset Court, felt that there the final plat as submitted is <br />significantly different from what was approved as the preliminary plat. <br />Crary felt that the visual impact with the proposed retaining walls was <br />totally different from what was reviewed as part of the preliminary plat. <br />Crary felt that the final plat as proposed should have to go back through <br />the public hearing process so that impacted property owners are aware of <br />the changes. Crary questioned whether the proposed lots were buildable <br />and asked if any soil borings have been done. He questioned the soil <br />conditions and the ability of these walls to hold the homes up. Crary <br />noted that when constructing his own home there were 20 feet of soil <br />corrections needed. <br />Angelique Kelly expressed concern with the addition of the retaining walls <br />to the final plat and stated that she would like the ability to have additional <br />information about these walls. <br />Tom Kelly stated that this is the first he has heard about the retaining walls <br />and was sure that many of the neighbors are unaware of this information. <br />Kelly was also concerned about the impact that grading will have on <br />existing vegetation. <br />-11- <br />
