MINUTES <br />PLANNING COMMISSION <br />NOVEMBER 13, 2003 <br />Elaine Zoch indicated that on Sunday's there is a generator running at the <br />CI Title building which causes a great deal of noise. Zoch felt that the <br />noise levels would violate the City's noise ordinance. Bougie agreed that <br />the generator is very loud. He indicated that he talked to Mr. Biagini <br />about this noise. Wilson reported that this is an emergency generator for <br />CI Title, and indicated that it does not run on a regular basis. The <br />proposed addition is for CI Title, therefore, there will be no additional <br />generators added. The existing generator will be sufficient to support the <br />building addition as well. <br />Keis asked if Wilson had any suggestions for resolving the problem with <br />the existing berm. Wilson suggested that the berm could be flattened and <br />grass planted. However, NIr. Biagini does not want to incur the cost of <br />doing so. <br />The City Administrator reported that the matter has been discussed with <br />Mr. Biagini, who has indicated that he does not want to pay the cost. Who <br />will pay the cost of correcting the problems with the berm is one issue that <br />is currently being negotiated with .Mr. Biagini. The Administrator <br />suggested that relative to addressing the noise issue, an enclosure or <br />screening for the generator might be the solution. <br />Elaine Zoch reported that when the CI Title building was constructed, <br />there were problems with construction access and parking on Condit Street <br />as well as construction activity occurring as early as 4 a.m. Zoch asked <br />that the City restrict these activities for Phase II. <br />The City Administrator reported that Mr. Biagini was contacted about the <br />access and parking violations, and also pointed out that the City's <br />ordinance prohibits construction activities before 7 a.m. The <br />Administrator indicated that the City can again prohibit construction <br />access and parking along Condit Street. The City would enforce that <br />restriction as well as the Code relative to construction hours. <br />Knudsen recommended approval of the Preliminary & Final Plat for <br />Country Side Terrace Phase II as well as Development Stage and Final <br />Stage PUD as requested by Richard Biagini, RAB, LLC subject to <br />compliance with the recommendations of the City Engineer and the City <br />Planner, subject to Mr. Biagini working with City staff to make <br />corrections to the existing berm and providing continuity between the two <br />parcels along Condit Street, subject to resolution of the noise problems <br />with the existing generator to the satisfaction of City staff either through <br />an enclosure or screening, and subject to a prohibition on construction <br />traffic and parking along Condit Street. <br />8- <br />
