Nlr. Joel R. Hanson
April 1, 2002
Page 2
Even if this ordinance would withstand a legal challenge, it does not prohibit the
property owners from removing vegetation from the property. In fact, by putting a
moratorium on development, it removes the property from regulation by Zoning Code
Chapter 903.020 G, which provides limitation on the removal of trees in new
developments. Enclosed is a copy of a letter to Cliffton Aichinger requesting that he
participate in a determination of the buffer/non-disturbance area.
As I informed you via telephone, the Palmen's are willing to wait until after the
April 10, 2002 Council meeting before they begin removal of vegetation from their
property.
The Council mi_~st understand that the property in question does not belong to the
City or to the outspoken neighbors. If the City wishes to purchase the property they
may do so by eminent domain. If they do not wish to purchase the property, we expect
them to treat the development of this property in the same reasonable way they have in
other developments within the City.
Thank you in advance for your responses to my requests.
Sincerely,
~'~/~~~~
George A.
