MINUTES CITY COt!NCIL APRtL 10, 200? A member of the audience suggested that liquor license fees be based on percentage of liquor sales. LaValle pointed out that the courts have determined that liquor license fees cannot be based on sales. N[r. Anderson introduced the following resolution and moved its adoption: 2ESOT_ UTION NO. 2002-9-~40 - INC'REAS/;VG ON-SALE LIQUOR LICENSE FEES TO X3,250 PER 3'E,1R POR TfIG LICENSE YEARS 2002 AND 2003 The foregoing resolution was duly seconded by Fahey. Ayes (5) Anderson, Fahey, Scalze, Montour, LaValle. Nays (0). Resolution declared adopted. PALiVLGN Fahey noted the City Attorney's report dated April 5, 2002 relative to the PROI'CI2TY reclassification of the Turnquist/Palmen property to taxable. The City Administrator indicated that the reclassification is currently being completed • by the County. They are also in the process of determining how many years they can go back and collect property taxes on this land. Fahey indicated that the County's reclassification of this property as taxable land brings back the issue of how much of the land is developable subject to compliance with the City's codes. Fahey also noted that the City currently has a moratorium on this property in order to allow the Council time to study these issues. Fahey indicated that while the ordinance is in place there can be no disruption of the property in terms of excavation, removal of trees and vegetation, etc. George LeTendre, atta~ney representing NIr. Palmen, indicated that any removal of vegetation from this site would be only in the area where a road could be develoued. LeTendre indicated that he knows of nothing in the moratorium ordinance that would prohibit the removal of vegetation where a proposed road would be located. LeTendre indicated that his client is waiting to see what the Council does before deciding how he will approach the issue. LeTendre indicated that in 1999, Nh~. Palmen brought forward a concept development proposal for this land that was reviewed by the Parks & Recreation Commission, the Planning Commission, and the City Council. This concept plan was approved for is single-family lots. As part of the concept plan, 23 acres would be dedicated to the City at no cost. LeTendre indicated that the Parks & Recreation Commission had indicated that the property that would be dedicated to the City would be used for a boardwalk or observation deck. LeTendre noted that the City Planner, City Engineer, and Fire Department all looked at the concept plan and approved it as proposed,
