'fhe City Council finds that the placement of benches r : or near mass-transit stops in the C ity provides a necessary service to the persons waiting for buses. Tlxe placement of such bend .es typically is on or near the public riglxt-of--way, and can rflFCt the safe flow of haffc. The C ,ry Council also finds that the location of such benches in res::iential districts can potentially intc:rF re with the quiet enjoyment of adjoining property owners auc residents. Ir, light of these findings, 2e City Council enacts this Division to regulate and license c nu(esy benches in the City. DEFINITIONS. The following words and terms, when used in this Divis on, shall have the following meaui:r s wiles the context clearly indicates otherwise: Courtesy Bench -arty bench or similar sk•ucture placed is th, City on or adjacent to the puh:.c rights-of--way at or near mass-transit stops for the use of tl :general public. Issuing Authority -the City License Section. City Engineer -the person appointed by the City Maciager a ex.ghieer for the City or the engineer s designee. LICENSE REQUIRED. No person, firm or corporation shall place or maintain any ~ .~wtesy beach in the City without :fi;, t obtaining a license pursuant to this Division. LICENSE APPLICATION. An application for a license pursuant to this Division shall : ; qr est the followhng information; (a) The name of the applicant. (b) Whether the applicant is a natural person, partnership, :urporaliott, or other association. (c) Tlxe address and telephone nwnber of the applicant. (d) A detailed list showhxg the exact requested location of :ac:x proposed courtesy bench. (e) Evidence of the consent o£ the adjoining property ow rer;: or lessees within 100 feet of th+ proposed location of the courtesy bepCh if any of the adjoinin ; praporty within 100 fccl of Ilse bevel is zoned residential. LICENSE FEE. p.2 The fee for a license issued pursuant to this Division shall be as fixed by the City Council, b;, resolution, from time to time.
