MTNUTCS
PLANNING COMMLSSION
JUNK, l3, 2002
the City Planner and that the business use of the property would be a
primary use rather than an accessory use.
Motion seconded by Wojcik.
Motion carried 6 - 0.
Gott-'indicated that he may withdraw his application and reapply utilizing
his Dianna Lane property. The City Planner suggested that Mr. Goff meet
with him during staff hours next week given that there are some home
occupations that are permitted without the need for a Special Use Permit.
These can be explored in relation to the Dianna Lane property given its
primary use is residential.
CUP TO The City Planner noted that the property at 355 Little Canada Road was
ENPAND NON- recently rezoned from t3- ~ to R-E3 in order that the property owner could
CONFORMING replace the existing house on the property with a new home. The property
STRUCTURE - owners have now decided that rather than replace the existing house, they
355 LdTTLE would add onto the existing house. The setbacks for the existing house do
CANADA ROAD - not meet the minimum Code requirements, therefore, a Conditional Use
YOUNGS/rULLER Permit would be necessary to expand anon-conforming structure. The
Planner noted that his only concern with this request is that access to the
existing garage is maintained. It was noted that the site plan does not
show the location of the driveway.
Given that the applicant was not present at the meeting, the Commission
decided to delay discussion of this matter until later on the agenda.
CONCEPT FOR "fhe City Planner noted that many properties along Little Canada Road
REZONING east of 35G are zoned General Business (B-3) although they are being
CERTAIN used as residential. The Planner noted that when the Comprehensive Plan
L[1'TLE CANADA was first adopted in 1980, the Cify envisioned that this area would convert
ROAD to a business area. "1"his has not happened, existing residences have been
PROPER'I7ES well maintained and added onto, and it appears that the residential use
1~ ROM B-3 TO RC3 of this area will likely continue for the loner term. T'he recent update of
the Comp Plan acknowledged the mix of uses in this area and a rezoning
from B-3 to R}3 would be consistent with that Comp Plan update. The
rezoning of this property to Rl3 will provide for more flexibility for the
property owners, allowing residential properties to be upgraded or
replaced while still allowing some business use of the property. While the
RI3 zoning would not allow for an intense business use such as a
Walgreens, it would allow small office uses, for example.
_3_
