MINUTES <br />CITX CO~UNCII1 <br />JUNE 26, 2002 <br />REZONING <br />CONCEPT <br />REVIEW - <br />CERTAIN <br />LITTLE <br />CANADA ROAD <br />PROPER TIES <br />The Council reviewed the concept for rezoning, certain properties on <br />Little Canada Road east of 3SF, from General Business (B-3) to <br />Residential Business (R-B). Council noted that the Planning Commission <br />has recommended approval of this concept to rezone. <br />The City Planner pointed out that the existing B-3 zoning presents some <br />ditliculties for the residentially used properties. <br />- - - - - - Scalze noted that the area is a nice residential neighborhood and she felt it <br />would remain as such. Scalze noted that at one time the thought was that <br />this area would convert to a commercial strip. However, it does not <br />appear that this will happen. <br />LaValle asked what prompted review of this concept. The City Planner <br />noted that the Youngs/Fuller property was rezoned last year to R-B to <br />accommodate removal of an existing house and replacement with a new <br />one. When that application was reviewed, there was some discussion <br />about looking at the rest of the area given the existing residential uses. <br />The City Administrator also noted that the Cony~rehensive Plan comments <br />on the mix of residential and commercial uses in this area. <br />Don Smith, property owner in the area, asked what impact the rezoning <br />will have on his property. Smith noted that he has a business use next <br />door to him and there have been some problems with parking on this <br />property. <br />The City Planner noted that residential uses are permitted uses under the <br />R-B zoning but are non-conforming uses under B-3 zoning. The Planner <br />also noted that business uses will require a Conditional Use Permit under <br />the R-B zoning, which allows the City to review proposed business uses <br />and place conditions on those uses such as screening, fencing, etc. <br />Existing business uses would be allowed to continue, but would need to <br />obtain a CUP should they expand or change. <br />Scalze also noted that the B-3 zoning would allow a more intense business <br />use than is allowed in the R-B District. <br />Montour felt that the R-B zoning was an added benefit to the residents <br />given if there is a fire or natural disaster, they would be allowed to rebuild <br />their homes. Residential uses would not be allowed to re-establish under <br />the B-3 zoning. <br />George Rossez, Advent Construction, asked the disadvantages to him in <br />rezoning to R-B.
