MINUTES <br />CITY COUNCIL <br />DECEMBER 16, 2015 <br />if the alarm company shut off his fire alarm, it would shut off everyone's. <br />Montour questioned that after two false alarms, why didn't Dr. Louie <br />realize there was a problem. Dr. Louie stated that he later discovered that <br />the new authorized user information hadn't been provided to the alarm <br />company, so they would not change the contact information until the <br />previous owner could be reached and verify the change. The previous <br />building owner was being contacted when the alarms went off rather than <br />Dr. Louie, so he didn't know they had gone off the first couple of times, <br />and then had no control over how it was being handled because, per the <br />alarm company, he was not the authorized user. <br />Torkelson stated that the city has an appeal process for a reason and wants <br />to be more business -friendly, so he feels it would be reasonable to grant <br />this appeal since the circumstances were unique and mostly out of control <br />of the owner. All the Council agreed that this situation was unique and the <br />appeal should be granted. <br />Torkelson introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2015-12-234 — APPROVING THE APPEAL OF <br />DR. JASONLOUIE, OWNER OF TRUE CHIROPRACTIC, FOR <br />FALSE ALARM FEES TOTALLING $100.00, FOR ALL INCIDENTS <br />OCCURING BEFORE DECEMBER 16, 201 S, BECAUSE OF <br />EXTENUATING CIRCUMSTANCES THAT OCCURRED FROM <br />THE CONTRACTOR DURING REMODELING, AND THE <br />PREVIOUS BUILDING OWNER'S DELA YIN CONTACTING THE <br />ALARM COMPANY TO CHANGE THE A UTHORIZED USER. <br />The foregoing resolution was duly seconded by Fischer. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />DEVELOPMENT The Administrator stated that the city entered in to a development <br />AGREEMENT agreement with Masterpiece Homes, Inc. on October 17, 2013 for the 15 <br />AMENDMENT new lots in Pine Tree Ponds. He pointed out some key provisions of the <br />FOR PINE TREE agreement: <br />PONDS <br />Each property sold needed to have an estimated market value of <br />$450,000 as of January 2017, or an actual selling price of at least <br />$475,000, or a combined certificate of real estate value that <br />averages greater than $475,000. <br />Construction of three homes had to be started by December 31. <br />2013, at least 10 homes had to be started by December 31, 2014, <br />and all 15 homes had to be started by December 31, 2015. <br />
