STAFF REPORT TO: Mayor Keis and Members of City Council FROM: Heidi Heller, City Clerk DATE: January 22, 2016 RE: Public Hearing - Petition to Vacate Street and Alley Right-of-Way on the Cardigan Ridge Plat The Cardigan Ridge plat for the new senior living project by Hearth Development was reviewed by Ramsey County, and the surveyor noted that there is right-of-way for two streets (Sixth Street and Middle Street) and two alleys that has not been vacated. The developer, Hearth Development, submitted a formal petition on December 15, 2015 to vacate these areas. These right-of-way areas are over where the pond is on the property, so it’s very unlikely that streets would have ever been built here. The current owner of the property that will be developed for the Cardigan Ridge senior living project, Rum River Equity, LLC, is the only owner that would be affected by this right-of-way vacation, and they will be selling the property soon to Hearth Development. Staff recommends approving the vacation of right-of-way on the Cardigan Ridge plat as described below: STREET AND ALLEY VACATION IN RICE STREET MOTOR LINE ADDITION All that part of Sixth Street which lies east of a line, parallel with and distant 50.00 feet east of the west line of Section 31, Township 30 North, Range 22 West, and which lies westerly of the southeasterly extension of the southwesterly right of way line of the street and utility easement described in Ramsey County Document Number 2268455, and all that part of Middle Street lying north of the centerline of vacated Fifth Street and lying south of the westerly extension of the southerly right of way line of the street and utility easement described in Ramsey County Document Number 2268455 and the alley looking lots in Blocks 3, 4, 5 and 6 according to the recorded plat of RICE STREET MOTOR LINE ADDITION, on file and of record in the office of the County Recorder, Ramsey County, Minnesota.
