<br />CITY OF LITTLE CANADA <br />RESOLUTION NO. 2016-1-22 <br />VACATING SIXTH STREET, MIDDLE STREET AND ALLEYS <br /> <br /> <br /> <br />WHEREAS, <br /> <br />A majority of the owners of property abutting certain street and alley right-of-ways have <br />requested the City Council in a petition dated December 15, 2015 to vacate such right -of-ways <br />according to law; <br /> <br />WHEREAS, <br /> <br />A public hearing to consider the vacation of these street and alley right-of-ways was held on <br />January 27, 2016 before the City Council at the City Center located at 515 Little Canada Road in <br />said City at 7:30 p.m. after due published and posted notice had been given by the City Clerk, as <br />well as a reasonable attempt to give personal mailed notice to all affected property owners on <br />January 8, 2016, and all interested and affected persons were given an opportunity to be heard; <br />and <br /> <br />WHEREAS, <br /> <br />Any person, corporation, or city owning or controlling easements contained upon the property <br />vacated, reserves the right to continue maintaining the same or to enter upon such way or portion <br />thereof vacated to maintain, repair, replace, remove, or otherwise attend thereto; and <br /> <br />WHEREAS, <br /> <br />It appears that it will be in the best interest of the City to approve such petition; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LITTLE <br />CANADA, COUNTY OF RAMSEY, MINNESOTA, that such petition is hereby granted and <br />the following Sixth Street, Middle Street, and two alley right -of-ways are hereby vacated: <br /> <br /> <br />LEGAL DESCRIPTION <br /> <br />All that part of Sixth Street which lies east of a line, parallel with and distant 50.00 <br />feet east of the west line of Section 31, Township 30 North, Range 22 West, and <br />which lies westerly of the southeasterly extension of the southwesterly right of <br />way line of the street and utility easement described in Ramsey County Document <br />Number 2268455, and all that part of Middle Street lying north of the centerline of <br />vacated Fifth Street and lying south of the westerly extension of the southerly
