MINUTES <br />PLANNING COMMISSION <br />AUGUST 8, 2002 <br />Keis noted that the Commission does not have the authority to change <br />ordinances, and must use the City's ordinance as they exist when <br />considering development proposals. <br />Jensen pointed out that the State's required setback from pipelines applies <br />to structures or buildings and not to roads. <br />Allan pointed out that there are people from Williams Pipeline in the room <br />this evening, and none of them can assure the neighbors that an accident <br />will not happen. Keis pointed out that we always live with some kind of <br />risk. <br />Allan felC that the reason the 20 foot setback is shown on the plans rather <br />than a 30 foot front yard setback, is that one lot would be lost if a 30 foot <br />setbacl: is required. <br />Dr. Allan asked who would pay in the event of a pipeline disaster. Jensen <br />indicated that the property owner would pay. Tom Kelly reported that <br />there is a shed in his backyard that was constructed several years ago <br />when there was a pipeline spill in the area. <br />Joe Pugaczewski reported that he used to fly pipelines for Williams, and <br />indicated that spills do occur when construction occurs during the winter <br />months when the ground is frozen and equipment is vibrating the ground. <br />Pugaczewski asked if any environmental studies have been done. <br />Keis pointed out that this is a preliminary plat review and noted that if an <br />approval is granted, it will be contingent upon a number of things. Keis <br />also noted that the Commissioners are not en~~ineers, and the Commission <br />will rely on the City Engineer to ensure that engineering details are <br />properly addressed. <br />Allan asked if there was sanitary sewer to Lot l . <br />McDonald reported that there is sanitary sewer along McMenemy Road <br />and they will bring in sanitary sewer from McMenemy to service this <br />development. Sanitary sewer may be brought in from Viking Drive to <br />service the ne~n~ lot on Preserve Trail. No~a~ever, in extending utilities, the <br />Williams Pipeline will not be disturbed. <br />Hartigan questioned how the Conunission could recommend approval of a <br />preliminary plat when the pipeline has not been located. Knudsen noted <br />that the issue of the pipeline will have to be resolved before the final plat <br />is acted upon. <br />-10- <br />
