<br />2. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed site is or will be compatible with present and future land uses of <br />the area. <br /> <br />3. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use conforms with all performance standards contained herein. <br /> <br />4. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use will not tend to or actually depreciate the aggregate property <br />values in the area in which the amendment or conditional use is proposed. <br /> <br />5. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use can be accommodated with existing public services and will <br />not overburden the City's service capacity. <br /> <br />6. The applicant shall demonstrate by clear and convincing evidence that the <br />development of the conditional use shall reflect the architectural character <br />of the conforming buildings in the surrounding area in regard to the <br />following: <br /> <br /> a. Proportion, scale and roof line; <br /> b. Architectural style; and <br /> c. Exterior finish materials. <br /> <br />Private garages are a permitted accessory use in the R-1 District. The subject site is <br />guided for low density residential land uses by the Comprehensive Plan. Provided <br />certain conditions are upheld, the proposed garage will be compatible with existing and <br />future land uses in the area. The proposed garage must comply with the required <br />performance standards as discussed below. <br /> <br />Setbacks. The Ordinance requires attached accessory structures to be treated as part <br />of the principal structure, and set back not less than 30 feet from the front lot line; 10 <br />feet from side lot line; and 30 feet from the rear lot line. The garage is proposed to <br />located in the east side of the property; greater than 10 feet from the side (east) lot line <br />and greater than 30 feet from the rear (north), and front (south) lot line. Applicable <br />setback requirements have been satisfied. <br /> <br />Lot Coverage. According to the Ordinance, “over-sized” garages requiring Conditional <br />Use Permits must not occupy more than 10 percent of the rear yard when total garage <br />space is more than 1,000 square feet. The rear yard of the subject property measures <br />33,258 square feet in total size, the majority of which, is in the rear yard. The garage <br />protrudes 168 square feet into the rear yard, well below the 10 percent threshold. <br /> <br />Accessory Building Area. The total garage space upon the property may not exceed <br />1,500 square feet. The proposed garage will be 1,362 square feet of garage space.
