CITY OF LITTLE CANADA <br />RAMSEY COUNTY <br />STATE OF MINNESOTA <br />ORDINANCE NO. 2016 - <br />PLANNING MORATORIUM <br />AN ORDINANCE ESTABLISING A TWELVE (12) MONTH MORATORIUM WITHIN <br />THE CITY FOR THAT AREA BOUNDED BY SOUTH OWASSO BOULEVARD ON <br />THE SOUTH, CANADIAN PACIFIC RAILROAD RIGHT-OF-WAY ON THE WEST, <br />BURLINGTON NORTHERN RAILROAD RIGHT-OF-WAY ON THE NORTH, AND <br />ST. PAUL REGIONAL WATER SERVICE RIGHT-OF-WAY ON THE EAST, FOR THE <br />PURPOSE OF CONDUCTING A REVIEW AND STUDY OF THE COMPREHENSIVE <br />PLAN AND ZONING CONTROLS OF SAID AREA. <br />The City Council of the City of Little Canada, Ramsey County, Minnesota does hereby ordain: <br />SECTION 1. FINDINGS PURPOSE AND INTENT <br />1.01 Findings. The goal of all comprehensive plans and zoning controls is to ensure that <br />allowed uses within a City are compatible. Compatible land uses promote public health, enhance <br />the collective values of all properties and allow for the efficient delivery of public services. <br />Due to the mixture of present land uses occurring within the Area, as well as proposed <br />uses, the City is concerned that potential incompatible uses may occur or already exist. <br />Incompatible uses adversely affect property values, public health and the efficient delivery of <br />services by the City. <br />1.02 Purpose. There is a need to study land uses and other issues affecting the property <br />described above to determine what amendments to existing regulatory controls may need to be <br />adopted to protect the public health, safety and welfare. The City Council, by adopting this <br />Ordinance, is hereby directing staff and the City Planning Commission to conduct studies <br />regarding proposed land uses as well as other regulatory controls to assure that land uses within <br />the Area are compatible and in the best interest of the City. That time is required for this purpose <br />before proposals for amendments to the comprehensive plan and zoning regulations can be <br />prepared and considered at a public hearing. <br />1.03 Intent. The City Council finds, therefore, that a moratorium is required in order to <br />protect the planning process and to prevent proposals for land use and development of lands <br />within the Area pending the completion of necessary studies and the consideration and <br />implementation of new regulations on that subject. At the present time it is expected that the <br />necessary study and implementation can be completed within a one (1) year period. <br />4 <br />
