SECTION 2. MORATORIUM ESTABLISHMENT. <br />2.01 Establishment. In accordance with the findings set forth in the preamble of this <br />Ordinance and pursuant to the authority of Minn. Stat. 462.355 (subd. 4) there is hereby <br />established a moratorium on the filing or acceptance of plans for the subdivision, development <br />and use of property located within the Area set forth above. This moratorium shall include all <br />applications for the constructions, erection, placement, reconstruction, enlargement or expansion <br />of any improvement located within the Area. <br />During the period of the moratorium, application for involving any subdivision, conditional <br />use permit, interim use permit, variance, final site, building plan approval, building permits, and <br />other permits and approvals related to land located within the Area shall not be accepted by the <br />City. Neither the Planning Commission nor the City Council shall consider or grant approval of <br />any application required for approval of any activity set forth above shall be issued. <br />SECTION 3. DEFINITIONS. <br />3.01. Definitions. For the purpose of the moratorium the term "Area" shall pertain to all <br />of the following: <br />A. Area: Area shall mean and refer to all real property, including uses of improvements <br />located thereon, lying within that area of the City bounded by South Owasso <br />Boulevard on the South, Canadian Pacific Railroad Right -of -Way on the West, <br />Burlington Northern Railroad Right -of -Way on the North, and St. Paul Regional <br />Water Service Right -of -Way on the East. <br />SECTION 4. APPLICABILITY. <br />4.01 Applicability. This moratorium shall be applicable to all property and <br />improvements located thereon located within the Area. <br />SECTION 5. PENALTIES. <br />5.01. Penalties. Any person, corporation or other entity that constructs, erects, places, <br />reconstructs, enlarges or expands improvements within the Area in violation of this Ordinance <br />shall be guilty of a misdemeanor and shall be subject to any additional legal or equitable <br />remedies available to the City. <br />SECTION 6. EFFECTIVE DATE, <br />6.01. Effective Date. This Ordinance shall take effect upon its adoption (April , <br />2016) and publication (April , 2016) and shall be effective for twelve (12) months from its <br />effective date and shall expire at that time unless further extended or repealed at an earlier date. <br />5 <br />
