3 <br /> <br /> <br /> <br />Conditional Uses have two levels of review, based on the nature of the use. The first level are <br />those general standards that govern the review of uses in the Conditional Use category. The <br />second level are those specific standards that apply to use itself, whether those are li sted in <br />the zoning ordinance, or they are identified as relating to a specific parcel or business <br />location. <br /> <br />The general ordinance standards are as follows: <br /> <br />921.010.C. The Planning Commission shall consider possible adverse affects to the proposed <br />amendme nt or conditional use. Its judgment shall be based upon (but not limited to) the <br />following factors: <br />1. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Land Use Plan. <br />2. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed site is or will be compatible with present and future land uses of the <br />area. <br />3. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use conforms with all performance standards contained herein. <br />4. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use will not tend to or actually depreciate the aggregate property values <br />in the area in which the amendment or conditional use is proposed. <br />5. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />6. The applicant shall demonstrate by clear and convincing evidence that the <br />development of the conditional use shall reflect the architectural character of the <br />conforming buildings in the surrounding area in regard to the following: <br />a. Proportion, scale and roof line; <br />b. Architectural style; and <br />c. Exterior finish materials. <br /> <br />For Convenience Restaurants such as the proposed Little Caesar’s, the ordinance also <br />identifies a series of specifi c conditions that may apply to the proposal, as follows: <br /> <br />912.040.J. Drive-in and convenience food establishments provided that: <br />1. The architectural appearance and functional plan of the building and site shall not <br />be so dissimilar to the existing buildin gs or area so as to cause impairment in <br />property values or constitute a blighting influence within a reasonable distance of <br />the lot. <br />2. A strip of not less than five (5) feet shall be landscaped and screened in <br />compliance with Section 903.020.G of this Ordinance. <br />3. Each light standard island and all islands in the parking lot landscaped or covered. <br />4. Parking areas shall be screened from view of abutting residential districts in <br />compliance with Section 903.020.G of this Ordinance. <br />5. Parking areas and driveways shall be curbed with continuous curbs not less than <br />six (6) inches high above the parking lot or driveway grade.
