<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Little Canada Planning Commission <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: July 8, 2016 <br /> <br />RE: 3115 Labore Road – Accessory Building Conditional Use Permit <br /> <br />Analysis – <br />Bryan Davis, Property Owner, is applying for a Conditional Use Permit to allow for a second detached <br />accessory storage building on his property at 3115 Labore Road. The subject parcel is zoned R-1, <br />Single Family Residential. This property is located in the northeast corner of the city limits on the <br />corner of Labore Road and County Road D. The parcels to the north on County Road D are within the <br />City of Vadnais Heights jurisdiction. The properties to the south, east, and west are in Little Canada <br />and are also all zoned R-1, Single Family Residential. <br /> <br />The property currently has one detached garage that is 24 x24 (576 sq. ft.) and one garden shed that is <br />roughly 10x11 (110 sq. ft.). The CUP request is to build a second detached accessory storage building <br />that would be 12x16 (192 sq. ft.). Upon approval, the applicant has indicated he would be removing <br />the existing garden shed. The proposal is for two detached accessory buildings totaling 768 square <br />feet. The total accessory structure square footage is less than 1,000 square feet which under the <br />zoning code is allowed by administrative staff review. However, that is only when the garage is <br />attached. Given the existing garage structure is detached, a Conditional Use Permit is required under <br />city ordinance 903.020.D.5.b. <br /> <br />Requirements - <br />Under the Zoning Code 903.020.D.5, the following are allowed accessory structures for single family <br />residential properties: <br /> <br />5. Subject to the other regulations in this Section, each single family lot shall be eligible for the <br />following accessory structures: <br /> <br />a. Permitted Accessory Structures. <br /> <br />(1) One (1) garage structure, whether attached or detached; <br /> <br />(2) One (1) recreational accessory building of no more than one hundred sixty (160) <br />square feet, and with no horizontal dimension of more than sixteen (16) feet in length or <br />width as a permitted use. For the purposes of this ordinance, a recreational accessory <br />structure shall be designed for temporary and seasonal occupancy, but shall not <br />include permanent storage of materials. Examples of such structures shall include <br />gazebos, detached porches, or similar buildings. <br />
