<br />(3) One (1) garden shed, provided that: Such sheds shall be constructed of materials and <br />colors similar and/or complementary to the principal building; shall not utilize either <br />corrugated fiberglass or metal siding or roofing; shall be no higher than twelve (12) <br />feet in height; shall be utilized solely for storage of materials and equipment accessory <br />to residential dwellings; and shall not be utilized for shelter or accommodation for <br />animals of any kind. <br /> <br />(4) One detached garage as a second garage on the property, under the following <br />conditions: <br /> <br />(a) The other garage structure is an attached garage. <br />(b) The proposed detached garage meets all of the conditions of Section <br />903.020.D.2 of this Ordinance. <br />(c) The total of all garage and accessory structure space on the property does not <br />exceed one thousand (1,000) square feet. <br /> <br />b. Conditional Use Permit. Beyond the limitations of Section 903.020.D.4. and 903.020.D.5 of <br />this Ordinance, the construction of an additional garage structure, an additional accessory <br />building, or an additional garden shed shall require the processing of a Conditional Use Permit <br />subject to the provisions of Section 921 of this Ordinance. When a Conditional Use Permit is <br />issued to exceed one thousand (1,000) square feet of garage and accessory building area, the <br />parcel shall not be eligible for a detached garden shed as otherwise permitted by Section <br />903.020.D.5.a.(3) of this Ordinance. Any existing such sheds must be removed as a condition of <br />the Conditional Use Permit. <br /> <br />Additionally, the following provision under 903.020.D.4 regulates that: <br /> <br />No accessory building or detached garage for a single family dwelling shall occupy more than twenty- <br />five (25) percent of the area of the rear yard. The total floor area of a garage and other accessory <br />buildings for a single family detached dwelling shall not exceed one thousand (1,000) square feet of <br />floor area per lot, except by conditional use permit pursuant to Section 921 of this Ordinance. In no <br />instance shall the total floor area of a garage and an accessory building for a single family dwelling <br />exceed one thousand five hundred (1,500) square feet. No Conditional Use Permit shall be issued for <br />detached accessory building or garage area of more than one thousand (1,000) square feet in which the <br />accessory building and/or garage exceeds ten (10) percent of the rear yard. <br /> <br />In this case, the combined square footage of the detached garage and accessory storage building are <br />under the twenty-five (25) percent of the rear yard requirement (which would be 1,091 square feet). <br />Again, the CUP requested is for two accessory detached structures with a square footage of up to 768 <br />square feet (576 sq. ft existing detached garage + 192 sq. ft. accessory storage building). <br /> <br />Lastly, the setback requirement for accessory buildings as required under 903.020.D.3 is ten (10) feet <br />to a rear of side yard property line. The proposed location on the site plan indicates compliance with <br />this provision. <br /> <br />Accessory buildings in residential zoning districts shall not exceed fifteen (15) feet in height, shall not <br />be closer than six (6) feet to any other building or structure on the same lot, and shall not be located <br />within a public drainage, utility or access easement. Subject to other provisions as contained in this <br />section, accessory buildings, uses and equipment may encroach into the required rear yard, but in no <br />case shall an accessory building, use or equipment be located closer than ten (10) feet to a rear yard or <br />side yard lot line except as may be specifically modified by this section or a specific use district. <br />
