MINUTES <br />PLANNING COMMISSION <br />JULY 14, 2016 <br /> <br /> - 2 - <br />The Associate Planner reported that property owner Bryan Davis, has <br />requested a conditional use permit to allow for a second detached <br />accessory storage building on his property at 3115 Labore Road. She <br />stated that the property currently has a detached 576 square foot garage <br />and a 110 square foot shed. She noted that the applicant will be removing <br />the existing shed after construction of a new 192 square foot shed. The <br />Associate Planner stated that a conditional use permit is required because <br />the request is for a second detached accessory building. She explained <br />that if the garage was attached and the total square footage for accessory <br />structures is less than 1,000 square feet, only administrative review is <br />required. She stated that accessory building coverage cannot exceed 25% <br />of the rear yard, and must be setback at least ten feet from side and rear <br />property lines. She stated that the proposed shed will meet the zoning <br />requirements. The Associate Planner stated that City Staff recommends <br />approval of the conditional use permit for a second detached accessory <br />building with the following conditions: <br /> <br />1. A certificate of survey will be submitted or evidence by locating <br />property corners will be required at the time of the building permit <br />application to verify that the new accessory structure complies with <br />setback requirements. <br />2. That within 30 days from the completion of the new accessory <br />structure, the existing shed is removed from the property. <br />3. That the accessory structure complies with all applicable building code <br />requirements. <br /> <br /> Bryan Davis, 3115 Labore Road, stated he wants to add more storage for <br />lawn and garden equipment, and the current shed is in poor condition. He <br />stated that he agrees to the conditions stated in the staff report. <br /> <br /> Buesing recommended approval of the Conditional Use Permit for a <br />second detached accessory building at 3115 Labore Road, with all of the <br />conditions stated in the Associate Planner’s report dated July 8, 2016. <br /> <br />Motion seconded by Sandell. <br /> <br />Motion carried 6 – 0. <br /> <br /> <br />The Associate Planner stated that this request is for a Planned Unit <br />Development Amendment to allow an adult daycare at 80 Little Canada <br />Road East, which is a multi-tenant building. She stated that the property is <br />now zoned Planned Unit Development, but in 2013, the property was <br />zoned B-3, General Business and a conditional use permit was approved <br />for an adult day care use in the same space. She explained that tenant did <br />CONDITIONAL <br />USE PERMIT - <br />ALLOW A 2ND <br />ACCESSORY <br />BUILDING – 3115 <br />LABORE ROAD, <br />BRYAN DAVIS <br />PLANNED UNIT <br />DEVELOPMENT <br />AMENDMENT – <br />ALLOW ADULT <br />DAYCARE – 80 <br />LITTLE CANADA <br />ROAD E, SUITE 1, <br />PAY SOUNG
