<br />City staff has not had issues in the past with Mr. Rossow’s properties in the Ryan Industrial Park as far <br />as being disorderly. He is a very diligent property owner who keeps regular tabs on his tenants to make <br />sure that any junk or debris is removed right away. The site plan does not indicate the fire lane access, <br />but city staff has confirmed that because of the maneuvering of trucks and trailers around the site that <br />the drive aisles are actually wider than 20 feet. City staff will work with Mr. Rossow to get an updated <br />site plan to reflect the minimum 20 foot fire access aisles. <br /> <br />8. The storage area shall be fenced and fully screened from adjoining non-industrial property, park and <br />trail areas, and public right of way. Where properly fenced and screened, outdoor storage may encroach <br />into the required side or rear yard setback area. Gates may be excluded from this screening requirement <br />as provided for in Section 903.020.O.6. <br /> <br />An existing chain-link fence does enclose the proposed storage area with gates on both the north and <br />south side of the outdoor storage area. <br /> <br />9. Screening shall consist of masonry walls or fencing constructed of wood or vinyl, as well as <br />landscaping. Metal fencing may be used where landscaping provides a complete year-round screen and <br />is irrigated to ensure survivability in compliance with Section 903.020.F (Fences) of this Ordinance. <br /> <br />The current chain-link fence has slats used for screening. This was an approved option prior to 2010 <br />within the I-1 zoning district, but does not meet current code requirements for screening. The current <br />screening is sufficient and Mr. Rossow has indicated he does have plans to upgrade the <br />screening/fencing in the near future. As such, city staff recommends as part of this approval that Mr. <br />Rossow be allowed to continue using the existing chain-link fence with slats for screening for up to one <br />year. Within that one year period, the screening will be required to be upgraded to meet current code <br />requirements. <br /> <br />10. Waste or recyclable material shall be contained in a refuse container. All such containers shall be stored <br />within a screened enclosure within the rear yard of the property. <br /> <br />The site plan does not indicate the location of the waste containers, but this has not been an issue in the <br />past during inspections of the property. Staff will have the site plan updated to reflect the location(s). <br /> <br />11. The storage area shall be paved with asphalt, concrete, or other material approved by the City Council. <br /> <br />The City Council has approved storage area to be Class V gravel in the past for properties in this area. <br />No changes are proposed to what has previously been approved for these parcels. As such, city staff <br />recommends following this same practice for approval of Class V gravel in this area. <br /> <br />12. The storage area shall not occupy any space required for conformity to the parking regulations of the <br />Zoning Ordinance. <br /> <br />By combining the two lots there is ample parking for the current tenants who will now have access to <br />the parking spaces on the south parcel. <br /> <br />13. The property, including buildings and exterior site areas, shall comply with all applicable fire codes. <br /> <br />The Fire Marshal should comment on compliance with this regulation. However, I am not aware of any <br />fire code violations at 3167 Spruce Street that the Fire Marshal has noted since Mr. Rossow has own <br />this property. <br />
