MINUTES <br />PLANNING COMMISSION <br />JULY 14, 2016 <br />not move in to the building so the conditional use permit lapsed. The <br />Associate Planned stated that Staff recommends approval with the <br />following conditions: <br />1. The proposed use meets the City's commercial district zoning <br />requirements for group day care and the property is developed in a <br />way that facilitates the use without significant modification. <br />2. The applicant will be required to obtain all required State license(s) for <br />such facilities demonstrating compliance with applicable state and <br />local codes. <br />3. The applicant and/or property owner submits a revised parking plan <br />that shows an allocation of five (5) additional "proof of parking" <br />spaces which could be used by this tenant should they reach their <br />maximum number of clients served. <br />4. The proposed facility will not create parking and use demands on the <br />building or site that are equal to, or greater than, the designed capacity <br />of the property. <br />5. The applicant will follow the State licensing requirements through the <br />Minnesota Department of Human Services on the ratio required for the <br />number of employees to adults served, but in no event shall that ratio <br />exceed one employee to eight adults 1:8). <br />Sandell asked why the property was rezoned from B-3 to PUD. The City <br />Planner stated that the City amended some zoning in this area, and there <br />were only a few business zoned properties left on the perimeter of the <br />PUD district, so they were changed to Planned Unit Development to offer <br />more flexibility. <br />Applicants, Zack Lee and Pay Soung, stated that they want to open Twin <br />City Adult Day Services, Inc., a new adult day services business at 80 <br />Little Canada Road. Mr. Lee stated that they will be open to any ethnicity <br />and offer a large variety of activities and services for adults that qualify. <br />He stated their staffing level will rise as more clients attend in order to <br />comply with state staffing ratio requirements. Ms. Soung stated they will <br />provide transportation, but may contract with Metro Mobility if needed. <br />Duray asked how the food service will be operated. Ms. Soung stated they <br />will be using a food delivery service that is licensed through the state, and <br />will provide breakfast and lunch to their clients. The City Planner stated <br />that City staff will monitor the site for parking issues, and would then <br />address adding more spaces if that occurs. Ms. Soung stated the office <br />would be open Monday through Friday, 8 a to 5pm, and the clients would <br />be there from 9:OOam to 2:OOpm. She stated that the hours could be <br />expanded if they ever have that many clients. <br />-3- <br />
