MINUTES <br />PLANNING COMMISSION <br />JULY 14, 2016 <br />Schwalbach recommended approval of the Final Planned Unit <br />Development at 3338 Rice Street with conditions stated by the Planner. <br />Motion seconded by Schletty-Flores. <br />Motion carried 6 — 0. <br />DISCUSS NEW The City Planner stated that the Minnesota Legislature passed a new law <br />LEGISLATION this spring that requires cities to allow temporary healthcare dwellings, <br />FOR <br />unless the city takes action to opt -out of the law by September 1, 2016. <br />TEMPORARY <br />He recommends that the City opt -out since the law is written in a way that <br />HEALTHCARE <br />does not serve the interests of the City or the area population very well. <br />DWELLING <br />He noted that some cities are adopting City Code for separate second <br />UNITS <br />dwelling units to address the needs of extended families. The City Planner <br />stated that if the Planning Commission recommends that the City opt -out <br />of the law, it be put on the August Planning Commission agenda for <br />formal action, and will be published as a public hearing for Council action. <br />Duray asked if the City can opt -out for a year or two, and opt back in later. <br />The City Planner stated that it would be better to opt -out and then have a <br />discussion to create our own City Code to address what Little Canada <br />wants. Duray asked Staff if there has ever been a request for a temporary <br />dwelling unit. The Associate Planner stated there has not, and the City <br />Planner stated there have been a few requests over the years for a mother- <br />in-law apartment within the house. Duray asked about the time period for <br />the dwelling units stated in the statute. The City Planner stated the statute <br />allows for a temporary dwelling unit to be on a property for a six month <br />time period with one six month extension, but then what happens after that <br />year if there are long-term health issues for the individual. <br />Duray recommended adding opt -out of the Temporary Healthcare <br />Dwelling Units legislation to the August Planning Commission agenda. <br />Motion seconded by Schwalbach. <br />Motion carried 6 — 0. <br />ADJOURN There being no further business, Duray adjourned the meeting at 8:37 p.m. <br />Respectfully submitted, <br />Aeiiieller <br />City Clerk <br />-5- <br />
