MINUTES <br />CITY COUNCIL <br />OCTOBER 26, 2016 <br />Keis stated that the Fire Inspector had been to the mall and found issues <br />with the fire suppression system, and had made several attempts to contact <br />the property owner but received no response. The City Administrator <br />explained that the Fire Marshal has found there are issues with the fire <br />alarm and sprinkler system and there has been no response from the <br />property owner. Mr. Christenson stated that he will make sure the property <br />owner responds to the Fire Marshal. <br />Don Durose, 103 Rosewood Drive, stated that headlights will shine right <br />through the fence when the cars come around the corner. He noted the <br />fence condition has been an issue for the entire 26 years he has lived there, <br />and it keeps falling down, so it seems that it needs to be replaced and not <br />just repaired again. He stated that trash blows under the fence into his <br />yard, and he is concerned about noise, lights, people yelling, and vehicle <br />fumes. Keis asked the City Administrator if the Building Official could <br />look at the fence and determine if it can be repaired or should be replaced. <br />The City Administrator stated he will have the Building Official evaluate <br />the condition of the fence. Mr. Christenson stated that the owners are <br />willing to commit to making the eastern portion of the fence solid so no <br />light can come through. He noted that the north end of the site has a grade <br />change, so the fence is on top of a retaining wall. <br />Torkelson stated that any sort of angle to a vehicle will cause the light to <br />shine through the fence. He explained that he and the owner of 109 <br />Rosewood, parked a vehicle behind the mall in the traffic lane to see where <br />the headlights would shine. He stated that the houses on Rosewood sit <br />lower than the mall property, so the light actually goes over the fence and <br />shines onto the houses in some locations. He stated that it is uncommon for <br />a fast food restaurant site to have drive-thru traffic go between the building <br />and a residential property, and if it is laid out that way, it is most often next <br />to multi -family building, not single family homes. <br />Mr. Durose stated that all of the snow that gets piled up next to the fence in <br />the northeast corner of the mall property, melts and runs into his yard in the <br />spring. He explained that his yard is about 8 feet lower than the parking <br />lot, and is lower than his neighbors since he has a walkout basement. He <br />asked where the snow storage would be piled. The City Administrator <br />stated that a special purpose fence could be taller. Fischer stated that <br />nothing with this request will change the water runoff. Keis asked what the <br />traffic count would be for Little Caesar's restaurant. Mr. Christenson <br />stated a maximum of about 50 cars per day, with the majority coming <br />between 5:00pm and 8:00pm. Montour asked if Little Caesar's would <br />consider this location without a drive-thru. Mr. Christenson stated he does <br />not believe they would. <br />5 <br />
