MINUTES <br />CITY COUNCIL <br />OCTOBER 26, 2016 <br />PUBLIC <br />The City Planner stated that this case has been continued from the last <br />HEARING— <br />several meetings, and since then the property owner has been working with <br />CONDITIONAL <br />the Valvoline Oil Change owner and CVS on a plan that is agreeable to <br />USE PERMIT FOR <br />everyone. He stated that this request is to allow a new Little Caesar's to <br />A RESTAURANT <br />have a drive-thru window on the north side of the mall. He noted that the <br />DRIVE-THRU AT <br />first proposal was for traffic to enter the site in the north driveway, make a <br />THE RICE AT C <br />u -turn in the rear of the building pull up to the order board, and then exit <br />CENTER, <br />back out of the north driveway. He explained that this second proposal <br />2680-2688 RICE ST. <br />now has traffic entering in the middle curb cut which is shared with the <br />CVS pharmacy drive-thru and will become 2 -way traffic, going behind the <br />mall building and pulling right up to the pick-up window since the order <br />board has been eliminated. He noted that the pick-up window has been <br />moved further east to help if there are cars in the Valvoline drive aisles, and <br />the drive aisle on the north side of the building has been shifted to the north <br />and widened to allow traffic to exit better around Valvoline, and the trash <br />area was moved. The City Planner reported that the City Engineer has <br />verified that the conditions he requested have now been met, and noted that <br />there are still a few issues with the traffic conflict points, but he believes <br />the traffic flow is functional. The City Planner stated that his original <br />conditions have been addressed or are a non -issue now such as the removal <br />of the order board. He noted that the Planning Commission reviewed this <br />request and felt the changes made to the plans were satisfactory and <br />recommended approval. <br />Joseph Christenson, attorney representing the mall property owners, stated <br />that the pick-up window has been moved east to be further away from the <br />Valvoline stacking aisles. He explained that having Little Caesar's as a <br />new tenant will allow the mall owners to do some needed improvements to <br />the property like resurfacing the parking lot, restoring existing fencing, and <br />changing the exterior lighting fixtures to a cut-off style so light will not go <br />beyond the property. <br />McGraw stated that he is concerned about the business expanding their <br />hours in the future past 11:00pm. He noted that he would like to see <br />something in writing where Little Caesar's agrees to not extend the drive- <br />thru hours, or make that a condition of the approval. Mr. Christensen <br />stated they would agree to that as a condition for the operation of the drive- <br />thru. McGraw stated that he is also concerned about the lights coming <br />through the fence into the adjacent houses. Mr. Christenson stated the <br />existing fence style is alternating boards so light would only come through <br />if it is coming at an angle, and the fence meets the City Code requirements <br />for screening. Montour stated the fence was not initially intended to be <br />blocking headlights given traffic was not intended to go around the <br />buildings. Mr. Christenson stated there is already a shared cross access <br />easement over the driveway area between the mall and CVS. The City <br />Planner confirmed that had been put in effect when CVS was built. <br />M <br />
