MINUTES <br />CITY COUNCIL <br />NOVEMBER 30, 2016 <br />RESOLUTION 2016-I1-205 -APPROVING THE TOWNHOME <br />PLANNED UNIT DEVELOPMENT AT 2736 & 2744 RICE STREET <br />WITHALL OF THE RECOMMENDATIONS IN THE PLANNERS <br />REPORT AND NOVEMBER 10, 2016 PLANNING COMMISSION <br />MINUTES, AND THESE ADDITIONAL CONDITIONS: <br />DEVELOPER MUST WORK WITHA FORESTER TO TAKE <br />PRECA UTIONS TO PROTECT ANY OAK TREES ON <br />NEIGHBORING PROPERTIES (PLAN CAN BE REVIEWED <br />BY CITYSTAFF), <br />DEVELOPER SHOULD PREPARE A GRADING PLAN TO IN <br />SUCHA WAYAS TO LEAST AFFECT OAK TREES ON <br />ADJACENT PROPERTIES, <br />INCLUDE A DISCLOSURE STATEMENT IN THE <br />TOWNHOME SALES MATERIALS STATING THAT THE <br />STREET IN THE DEVELOPMENT IS A PRIVATE STREET <br />THAT WILL ALWAYS BE OWNED AND MAINTAINED BY <br />THE HOMEOWNERS ASSOCIATION, <br />ENTER INTO A DEVELOPMENT AGREEMENT WITH THE <br />CITY GOVERNING THE CONSTRUCTION OF THE <br />PROJECT, <br />REVIEW THE EXTERIOR LIGHTING NEXT TO THE PATIO <br />DOOR TO SEE IF THEY SHOULD BE HOODED TO <br />PREVENT LIGHT SHINING ON NEIGHBORING <br />PROPERTIES, <br />INSTALL A FENCE ALONG THE SOUTH PROPERTY LINE <br />FOR SCREENING OF THE 81 & 91 IONA LANE <br />PROPERTIES WHERE GAPS BETWEEN THE UNITS EXIST <br />AND TO SHIELD THE ROAD TURNAROUND. WHEN THE <br />TREES HAVE GR0WNAND THE FENCE CONDITION HAS <br />DETERIORATED AND NEEDS REPAIR, THE <br />HOMEOWNERS ASSOCIATIONIS NOT REQUIRED TO <br />KEEP THIS FENCE. <br />The foregoing resolution was duly seconded by Fischer. <br />Aye (5). <br />Nays (0). Resolution declared adopted. <br />PUBLIC <br />The City Planner stated this request is for a comprehensive sign plan that is <br />HEARING— <br />part of the redevelopment of Taco John's at Rice Street and Country Drive. <br />COMPREHENSIVE <br />He noted the building was approved and now the developer has submitted <br />SIGN PLAN FOR A <br />the sign plans. He explained that all of the signs proposed are well within <br />NEW <br />the allowed signage amounts, and meet the architectural guidelines. He <br />COMMERCIAL <br />noted that since the Planning Commission meeting, the applicant has <br />BUILDING AT <br />3340 RICE ST; <br />THK, LLP <br />4 <br />
