<br />(2) Apply for an Interim Use Permit that would grant approval to allow these specific uses on <br />the property for a defined period of time <br />(3) Discontinue other rental/non-tenant outdoor storage (i.e. subcontractor storage including <br />materials & equipment and semi-trucks or trailers) <br />As a result, Mr. Erdmanis has appealed staff’s interpretation of grandfathering and feels these “other” <br />uses are similar to a contractor use of the site like Buck Blacktop and are a continuation of use. He is <br />requesting that the grandfathering classification allow for outdoor storage of construction materials, <br />equipment, and vehicles for tenant (Buck Blacktop) and non-tenants of the building which all share the <br />same type of work or of similar equipment. <br /> <br />City staff would like to clarify the reason for Option #2. This was an attempt to work with Mr. <br />Erdmanis given he has repeatedly told city staff that his property along with several adjacent properties <br />along South Owasso Boulevard have potential for redevelopment. Mr. Erdmanis has expressed <br />interest in selling his property along with the residential property he owns at 30 S. Owasso Boulevard. <br />Therefore, city staff presented Mr. Erdmanis with the option to amend the city code for an Interim Use <br />that would allow for his current uses (which staff has deemed in violation) to continue as legal non- <br />conforming for a defined period of time with specific conditions. Mr. Erdmanis has again contended <br />that these uses are all grandfathered under the umbrella of contractor type operations and therefore he <br />does not need an Interim Use Permit. <br /> <br />It is staff’s determination that the current uses on the site are an expansion of the grandfathering rights <br />for the property. The documented occupant of the property is Buck Blacktop. The right to continue <br />the Buck Blacktop operations is not what staff is recommending must be discontinue. However, that <br />use does not include the expansion of Buck Blacktop’s outdoor storage (i.e. square footage of outdoor <br />storage area as expanded and the stockpiling of recycled materials in the rear yard).
