<br />to the City for prohibited mailings or any mailing which occurs prior to City approval of <br />materials that are sent to residential dwelling units covered under this contract. The <br />Contractor is also responsible to give written notice to those residents within thirty (30) days as <br />to the error and reason for the prohibited mailing. The Contractor shall bear full responsibility <br />and expenses incurred for notifying residents of the prohibited mailing. <br /> <br />l. k.. The City shall impose a $2,500 charge per billing cycle should the Violating Contractor <br />fail to notify the City, within 30 days of a reduction in tipping fees as required by this <br />agreementContract. In addition to this charge, the Contractor shall also make a refund to the <br />City in the next billing cycle of any amount overcharged. <br /> <br />m. Violating Contractor’s failure to forward an account service call to the City for processing - <br />$50.00 per instance. <br /> <br /> <br />n. Violating Contractor’s direct billing of Little Canada residents covered by this organized <br />collection contract - $250.00 per instance. <br /> <br />o. Violating Contractor’s failure to notify the City of carts not being available “out of stock” for <br />delivery - $100.00 per instance. <br /> <br />p. Failure by the Contractor to schedule the Weekly Service Changes - $250.00 per instance. <br /> <br /> <br />4. Legal Compliance. <br /> <br />a. This Contract is governed in all respects by the laws of the State of Minnesota, and all <br />obligations are enforceable in accordance therewith; and the Contractor, where required, must <br />obtain all licenses or permits to transact a refuse collection business in the City of Little Canada, <br />Ramsey County, and the State of Minnesota. <br /> <br />b. The Contractor will acquaint itself with all pertinent City Ordinances and shall comply with <br />all health rules, regulations, and Ordinances of the City of Little Canada, Ramsey County, and <br />the State of Minnesota in effect at this time of this contract or hereafter adopted. In the <br />event, there is a conflict between the provisions of this contract and the pertinent ordinances, <br />regulations, and statutes the more stringent requirements shall apply. <br /> <br />c. The Contractor shall report all violations of ordinances pertaining to garbage and refuse <br />collection and disposal for enforcement purposes including all unsanitary or filthy conditions <br />to the City. <br /> <br /> <br />5. Safety. <br /> <br />The Contractor shall provide and maintain all sanitary and safety accommodations for the <br />use and protection of its employees as may be necessary to provide for their health and welfare and <br />comply with federal, state, and local codes and regulations, as well as those of other bodies and <br />tribunals having jurisdiction. Employee safety and sanitation facility regulations are set forth in <br />Minnesota Statutes 182 and in the Department of Labor and Industry's Labor Safety Code (LISC 73- <br />75). <br /> <br />
