2 <br /> <br />This issue was raised at the Planning Commission’s April 5, 2016 meeting. In consideration of <br />zoning district allowance, the Commission agreed that the keeping of backyard chickens should <br />be allowed in both R-1 and R-2 zoning districts if setback requirements can be satisfied. This <br />change, along with the removal of the minimum 12,000 square foot minimum lot size <br />requirement, is reflected in the attached amendment. <br /> <br />Amendment Provisions. With the exception of the two above-referenced changes recommended <br />by the Planning Commission, the provisions of the amendment are identical to those previously <br />reviewed informally by City Council. A summary of the various amendment provisions is <br />provided below: <br /> <br /> Application Requirements: <br /> <br />• The backyard chicken requirements would be imposed within the “Animal Control” <br />section of the City Code and would be allowed by annual permit <br />• First time permit applicants would be required to review educational materials related <br />to the keeping of backyard chickens <br />• A written application and permit fee would be required <br />• The application would include the following: <br />o Breed and number of chickens specified <br />o Agreement to comply with City conditions <br />o Property legal description and evidence of ownership <br />o Property owner consent for keeping of chickens <br />o Submission of site plan <br />o Payment of fee <br />• Annual permit renewal would be required <br /> <br />Zoning District Allowance: <br /> <br />Backyard chickens would be allowed within the City’s R-1, Suburban Single Family <br />Residential and R-2, Urban (Small Lot) Residential zoning districts. <br /> <br /> General Requirements: <br /> <br />• Occupancy - The owner of backyard chickens would need to reside on the premises <br />• Number of Chickens - A maximum of four chickens would be allowed <br />• Roosters - The keeping of roosters would be prohibited <br />• Prohibited Enclosures - The keeping of backyard chickens in a dwelling, garage or <br />accessory structure not meeting the requirements of the amendment would be <br />prohibited <br /> <br />Coop Requirements: <br /> <br />• Coops would be prohibited in front and side yards <br />• A maximum of one coop would be allowed per lot
