<br /> <br /> <br /> <br />LITTLE CANADA REFUSE & RECYCLING SERVICE CONTRACT <br /> <br /> <br />THIS CONTRACT, made and entered into this day of February 22, 2017, by and between the <br />CITY OF LITTLE CANADA, a municipal corporation in the County of Ramsey, herein referred to as <br />"City," and Republic Services, IncAllied Waste Services of North America, LLC, d/b/a Repub lic Services o f <br />th e Twin Cities (“Repub lic”) ., a Minnesota corporation, and Gene's Disposal, Inc., a Minnesota corporation, <br />and Waste Management of Minnesota, Inc., a Minnesota corporation, herein referred to collectively as <br />"Contractor." <br />R E C I T A L S: <br />WHEREAS, the City requires the collection and disposal of garbage and rubbish, and recyclables <br />from residences in the City of Little Canada; and <br />Whereas, the Contractor is a group of licensed haulers in the City of Little Canada engaged in the <br />business of collection and disposing of refuse, yard waste, and recyclables; and <br />Whereas, the City desires to hire the services of the Contractor and the Contractor desires to provide <br />services to the City; <br />NOW, THEREFORE, it is agreed by and between all parties: <br /> <br />I. GENERAL DESCRIPTION OF SERVICES. The Contractor shall supply all labor, materials, and <br />equipment necessary to make a complete collection of garbage and refuse from all residences in the City of <br />Little Canada at least once in each calendar week during the term of this Contract, single sort recyclables once <br />every two weeks, two so rt rec yclab les f o r cu sto mers of Gen e’ s Dispo sal on ce every week bulky items <br />weekly as scheduled, and yard waste on a weekly basis from April 1st through November 30th, weather <br />permitting for those participating customers. Such collections shall include all residential properties having <br />two (2) or less dwelling units in a single building by use of individual containers. The Contractor shall <br />provide all personnel, equipment, and facilities necessary to fulfill the terms and conditions of this Contract. <br />The Contractor shall provide said services in compliance with all applicable laws and shall charge for said <br />services on a volume-based schedule. <br /> <br /> <br />II. TERM OF CONTRACT. This Contract shall be in full force and effect for a five-year period <br />beginning January 1, 2017. <br /> <br /> <br />III. DEFINITIONS. For purposes of this Contract, the following terms shall have the following meanings: <br /> <br />A. Additional Collection Service. Refuse in excess of the designated volume-base per residential <br />dwelling unit or residential dwelling units desiring collection of items from a location other than the <br />boulevard adjoining the curb. <br /> <br />B. Appliances. Household items such as, but not limited to, refrigerators stoves, dishwashers,
