MINUTES <br />PLANNING COMMISSION <br />JANUARY 12, 2017 <br />recommending approval subject to some conditions, including what is in <br />the City Engineer's report. <br />Elizabeth Tschida-Miller, 91 Iona Lane, asked who is responsible for <br />removing the oak trees that are on her property if they die as a result of the <br />construction. Todd Franzen, Cash for Houses, LLC stated he assumes that <br />he would be responsible as the developer and builder. The City Planner <br />stated that one of the requirements of the PUD approval was that the <br />existing oak trees be protected as best as possible during construction. <br />Sandell recommended approval of the preliminary and final plats for the 14 <br />unit townhome Planned Unit Development at 2736 and 2744 Rice Street, <br />subject to the recommendations and conditions in the January 6, 2017 <br />Planner's report and January 6, 2017 Engineer's report. <br />Motion seconded by Schletty-Flores. <br />Motion carried 6 — 0. <br />CONDITIONAL <br />The Associate Planner reported that this request is for a conditional use <br />USE PERMIT FOR permit to operate a massage therapy business in an office park building at <br />A MASSAGE <br />2580 Rice Street. She explained that the property is zoned B-3, General <br />THERAPY <br />Business, which allows massage therapy by conditional use perinit as a <br />BUSINESS AS A <br />principal or accessory use. She stated that Ms. Chanda.Hin is requesting <br />PRINCIPAL USE; <br />approval of a conditional use permit to allow massage therapy as a <br />CHANDA HIN, <br />principal use. She explained that along with massage therapy, Ms. Hin's <br />BALANCED <br />business, Balanced Therapies, would offer other wellness services, <br />THERAPIES <br />including possibly some small classes. She stated that staff has verified <br />that Ms. Hin is the only employee of Balanced Therapies. The Associate <br />Planner reported that Ms. Hin is leasing 1,040 square feet in the lower level <br />of one of the office condos in the Edgewater Office Park. She noted that <br />this office park has a total of 90 parking spaces and staff has concerns <br />about there being enough parking in the office park as a whole. <br />The Planning Associate stated that Staff recommends approval with the <br />conditions stated in the Associate Planner's report, including that Ms. Hin <br />be issued a massage therapy business license, the business is limited to one <br />employee, and no more than four attendees to a class. She noted that an <br />amendment to the conditional use permit could be applied for if Ms. Hin <br />wants to change any of the conditions. <br />The Planning Associate stated that the City received a letter from Mark <br />Nygaard, 2588 Rice Street and president of the office park association, who <br />-2- <br />
