<br />parking with establishing 80 spaces on the property. It should be noted that Cummings Mobility is <br />proposing to convert 14 parking spaces to their display area and outdoor storage area. Staff has <br />already commented on the location of the display area and moving that to the south side of the <br />building. This would leave 66 spaces available for employee or customer parking. A condition of the <br />PUD approval would be that staff will work with Cummings Mobility on the driveway access options <br />and establishing the number of required parking spaces. It shall be a recommended condition of the <br />approval that by October 1, 2017, the applicant will bring the parking lot into compliance with the <br />code standards of Section 903.050 for establishing 80 off-street parking spaces. <br /> <br />Motor Vehicle Sales Lot. As mentioned, the applicant is requesting PUD approval for a motor <br />vehicle sales lot of up to six vehicles outside on the property and an inside display area for up to six <br />vehicles. The preferred location by the applicant for the display vehicles outside is in the six spaces <br />abutting Rice Street in order to maximize visibility. In discussions with staff, they have indicated a <br />willingness to move the display area to the first six spaces along the south side of the building or split <br />it up with three vehicles along Rice Street and three vehicles on the south side of the building. Since <br />they are dealing with new and used motor vehicles sales they fall under the State and City licensing <br />standards as a Dealer. However, the distinction with this use is that they have a specific clientele and <br />product that has been retrofitted for handicap accessibility which results in a smaller quantity of <br />vehicles (400 vehicles sold in 2016). <br /> <br />Our current city code states that “No more than a total of two (2) motor vehicle sales lot licenses may <br />be in full force at any one time in the B-2 and B-4 Districts, nor may more than a total of three (3) such <br />licenses be in force at any one time in the B-2, B-4, and I-1 Districts combined.”. Again, the PUD <br />District does not allow for Motor Vehicle Sales. As a result, a text amendment is part of this <br />consideration that would create a Handicap Mobility Motor Vehicles Sales Lot license under the city <br />code that is tied to the “handicap accessibility mobility” component. Staff has prepared language as <br />part of our PUD “F” District recommendation that would provide for this use specifically to this <br />property that is also subject to City and State licensing. Also, the code language that exists in B-2, B- <br />4, and I-1 will not need to be modified. With this zoning and license classification, it is transferable <br />only to a dealer handling motor vehicles with handicapped mobility features and is separate from the <br />Motor Vehicle Sales Lot license. The number of licenses allowed in B-2, B-4, and I-1 will remain the <br />same. <br /> <br />Staff believes the display of motor vehicles along Rice Street is not consistent with the District <br />Guidelines. The customers drawn to this business are a specific demographic and Cummings Mobility <br />does not necessarily target everyday traffic along Rice Street. Although the visibility brings awareness <br />to their business as a marketing tool, staff feels this would be better achieved through their sign plan. <br />By moving the location, the intent of the PUD District is being considered in how this use fits the area. <br />The applicant is willing to move the location of the display area, but would like the vehicles accessible <br />for customers to browse even during non-business hours. They considered having the vehicles behind <br />the building to be an issue for security. As a result, staff has recommended in our ordinance language <br />that all six vehicles be located on the south side of the building behind the front line of the building. <br />This location provides for some visibility, but leaves the parking spaces available for customers of this <br />multi-tenant building at the front of the building which is optimal. <br /> <br />Motor Vehicle Repair. From this location Cummings Mobility would also like to offer repair <br />services to their customers on the accessibility/mobility components of the vehicle. The applicant has <br />indicated that they do not perform any type of repair or service to a motor vehicle outside of the <br />mobility component (i.e. no oil changes, brakes, or engine work).
