5 <br />of any and all claims arising out of his employment relationship with the City. Any severance <br />payments will be made without a matching deferred compensation payment from the City. In <br />addition to said severance pay, Shearen shall be paid for any accrued PTO. However, in the <br />event Shearen is terminated because of his conviction for any illegal act involving personal <br />gain to his, then City shall have no obligation to pay the aggregate salary and PTO as provided <br />in this paragraph. <br /> If prior to October 10, 2017, City reduces the salary or other financial benefits to <br />Shearen in a greater percentage than across-the-board reduction for all City employees, or if <br />City refuses, following written notice, to comply with any other provisions of this Agreement <br />benefiting Shearen, then Shearen may, at his option, be deemed to be “terminated” on the date <br />of such reduction or refusal to comply with the provisions of this Agreement. In this event, <br />Shearen shall be entitled to severance pay in accordance with this Agreement. <br /> If Shearen voluntarily resigns his position with the City, Shearen agrees to give City <br />twenty-eight (28) days advance notice. If Shearen voluntarily resigns his position with City, <br />there shall be no severance pay due to Shearen, except as provided for in Section 14 of the <br />City’s Personnel Policy dealing with PTO. <br />16. OTHER PROVISIONS TO APPLY. Shearen shall be subject to Section 17 of City’s <br />Personnel Policy entitled “Computer Use Policy” and Section 18 “Other Information” during <br />his tenure with City. Shearen acknowledges receipt of this section as well as any other <br />sections of the Personnel Policy previously referenced in this Agreement. <br />17. SEVERABILITY. If any provision, or any portion thereof, contained in this Agreement is <br />held to be unconstitutional, invalid, or unenforceable, the remainder of this Agreement, or
