MINUTES <br />PLANNING COMMISSION <br />APRIL 13, 2017 <br /> <br /> - 3 - <br />Beltmann recommended approval of a of the subdivision of 2586 Spruce <br />Street into two single family residential parcels, as presented and subject to <br />the conditions in the staff report. <br /> <br />Motion seconded by Davison. <br />Motion carried 6 – 0. <br /> <br /> <br /> The Associate Planner stated that Neal Anderson, one of the property <br />owners of the Rice@C shopping center was approved for a conditional use <br />permit in 2016 to allow a drive-thru restaurant. She explained that one of <br />the Council’s conditions was that the fence along the east side be replaced <br />with a new and taller fence to improve the screening for the residential <br />homes on Rosewood Drive. Mr. Anderson is seeking approval of an eight <br />foot high special purpose fence on the east side of the property. The <br />Associate Planner explained that the existing wood fence was a <br />requirement in 1989 for the approval of the Rice @ C center development. <br />Since that time, the property was subdivided to allow for a CVS Pharmacy, <br />but the fence remains as screening to the adjacent homes. The Associate <br />Planner stated that Mr. Anderson will also be continuing the new eight foot <br />fence 25 feet into the CVS Pharmacy property in order for all of the <br />existing fencing on the east side to be replaced. She noted that CVS has <br />agreed to be responsible for the future maintenance of the fence section on <br />their property. She stated that Mr. Anderson will also be replacing the <br />fence on the north side of the property, but at its current height of six feet, <br />which is allowed by the City Code. <br /> <br /> Buesing clarified with Mr. Anderson that the different height fences would <br />meet at a corner. Mr. Anderson stated that it will be a professionally <br />installed commercial grade fence and will be done before the new <br />restaurant opens. Kwapick stated that he lives on Rosewood Drive right <br />behind this property and was happy that the fence was being replaced. <br /> <br /> There were no comments from the public. <br /> <br />Sandell recommended approval of a Conditional Use Permit for an 8 foot <br />tall special purpose fence on the east side of the commercial property at <br />2680-2688 Rice Street as presented in the staff report and subject to the <br />conditions in the staff report. <br /> <br />Motion seconded by Beltmann. <br />Motion carried 6 – 0. <br /> <br /> Kwapick recommend approval of a Conditional Use Permit to allow the 8 <br />foot tall special purpose fence to continue 25 feet onto the adjoining CVS <br />CONDITIONAL <br />USE PERMIT FOR <br />A SPECIAL <br />PURPOSE 8’ <br />FENCE AT 2680- <br />2688 RICE <br />STREET; <br />APPLICANT: <br />NEAL <br />ANDERSON, <br />LC-EH, LLC <br />
