<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of City Council <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: April 18, 2017 <br /> <br />RE: All American Recreation Indoor Retail Sales <br />In 2006, All American Recreation was granted a Conditional Use Permit to allow for Indoor Vehicle <br />Sales of motorcycles/scooters at 2940 Rice Street. At the time of the last license renewal period, All <br />American Recreation made the decision to discontinue this portion of their business and did not renew <br />their license with the City. Their previous license expired on June 30, 2016. <br /> <br />As the Council is aware, All American Recreation is consolidating their business and moving into a <br />smaller space within the same building as a result of the recent purchase of the property by Cummings <br />Mobility. Mr. Schiltz, All American Recreation Business Owner, had previously made other <br />arrangements to sell the remaining ten scooters titled to his business. However, that avenue for selling <br />the scooters is no longer feasible. As a result, Mr. Schiltz has requested to renew his Indoor Retail <br />Sales license from April 27, 2017 to June 30, 2017 in order to allow him the ability to sell the ten <br />remaining scooters in his fleet. <br /> <br />Mr. Schlitz has indicated that he does not intend to purchase any new scooters. It is his plan that after <br />the ten scooters are sold that he will discontinue his Indoor Retail Sales license. He has asked to have <br />until the June 30th deadline to coincide with our typical licensing period as a precaution, but hopes to <br />have these scooters sold quickly. Again, this is part of All American’s business consolidation. There <br />should be no conflict with licenses given the recent approvals for Cummings Mobility. All of the <br />scooters are kept inside the building (no outdoor sales or storage of the scooters would be allowed). <br />Cummings Mobility will be purchasing the property by the end of April, but it is staff’s understanding <br />that they will take a couple of months to switch their operations over to the Little Canada location. All <br />American Recreation has already begun shifting their business into their new space. Staff has told Mr. <br />Schiltz that once Cummings Mobility applies for their license to operate that his license for Indoor <br />Retail Sales would become null and void given the change in use would be effective. <br /> <br />The Conditional Use Permit issued to All American Recreation to allow for Indoor Vehicle Sales of <br />Scooters is still in effect for this property given that use was not discontinued for more than a year and <br />Cummings Mobility is not operating from this location. As a result, Mr. Schiltz would still be allowed <br />to apply for the license without any further zoning approval being needed. The Municipal Code <br />Section 803 provides for shorter license periods by City Council approval (see ordinance language <br />below). Please note this provision does not allow for a prorated fee and Mr. Schiltz is aware he would <br />be subject to a full year license of fee of $300.00. <br /> <br />803.020. APPLICATION, FEE AND LICENSE PERIOD. Application for used car dealers licenses shall be made <br />to the City on a form to be furnished by the City. The fee for such license shall be determined by City Council resolution
