As you are aware, the Contractor for the
project is Hardrives, Inc. The total amount earned by the Contractor on this partial pay
estimate is $3,898,503.67. Subtracting retainage of $80,808.65 and previous payments
of $3,727,806.75, the amount due the Contractor is $89,888.27.

This pay estimate includes payment for work that has been completed to date in the
Industrial Park including a portion of the storm sewer installation and a majority of the
watermain fitting investigation and repair. Also included with this letter is Supplemental
Agreement #5A. The location of private utilities required modification of the proposed
storm sewer system and the soils conditions and groundwater encountered during the
excavation required changes to the backfill requirements. These revisions are
addressed in Supplemental Agreement #5A.

We have inspected the work performed by Hardrives, Inc and find it to be in compliance
with the plans, specifications, and contract documents. Therefore we would recommend
approval of Supplemental Agreement #5A in the amount of $16,642.79 and Partial Pay
Estimate No. 9 in the amount of $89,888.27.

If you have any questions regarding this issue please feel free to call.

Sincerely,

ELFERING & ASSOCIATES
Lee Elfering, P.E.
City Engineer

cc: Bill Dircks, Public Works Director
